Present: Mayor Marcellus, City Clerk French, and the following council men: Crabb, Johnson, Heermann, Merriman and Stutz. Absent: Golden. The meeting was called to order and the following proceedings were had and done: The following Resolutoin was introduced by Councilman John son, who moved its adoptoin. RESOLUTION BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF O’NEILL, NEBRASKA: That the Mayor and Council hereby find and determine that pursuant to a contract heretofore made, Francis R. Orshek, Inc., of Fremont, Nebraska, has perform ed the work and furnished ma terials for the construction of street improvements in Street Improvement and Paving District No. 16 of the City of O’Neill, and the engineer in charge has filed with the City Clerk a certificate showing the furnishing of said material and the performance of said contract as follows: Estimate No. One — Amt. of Es timate, $47,070.60; Now Due Con tractor (80% of % of estimate), $18,828.24; Estimate No. Two— $49,944.20 (less previous estimates), Now Due Contractor (80% of % of estimate), $1,169.44. Warrants in the amount now due the contractor are hereby au thorized and charged to said Dis trict. Said warrants shall draw interest at the rate of 3J/4 per cent per annum. The foregoing resolution having been read, Councilman Merriman seconded the motion for its pas sage and adoption. After discus sion and consideration thereof, a roll call vote was taken on said motion, which resulted as follows: Aye — Stutz, Crabb, Heermann, Merriman and Johnson. Nay — None. Whereupon the Mayor de clared said Resolution passed and adopted. Motion by Stutz, sceonded by Crabb that Walter Schmohr’s sal ary be raised from $200.00 to $225.00 per month, starting No vember 1, 1955. Motion carried. Councilman Heermann intro duced an Odrinance entitled: “AN ORDINANCE RELATING TO SEWERS AND THEIR UP KEEP AND TO PROVIDE SER VICE CHARGES THEREFOR. COLLECTION THEREOF, ANT FOR THE USE OF THE FUNDS RAISED THEREBY.” Said Ordinance was fully anc distinctly read, and on motion dulj made, seconded and adopted, il was designated as Ordinance No 294A an the title thereof was ap Councilman Johnson moved that the statutory rule requiring Ordi nances to be fully and distinctly read on three different days be dispensed with, which motion was seconded by Councilman Stutz, and the Yeas and Nays being call ed on the passage of said motion, the following councilmen voted “Yea”: Stutz, Johnson, Crabb, Heermann and Merriman. Nay: None. The motion having been concurred in by three-fourths of the Council, was declared passed and adopted, and said statutory rule suspended. Thereupon said Ordinance 294A was read by its title a second time was then read at large and put upon final passage. The May or stated that the question is: “Shall Ordinance No. 294A be passed and adopted?” The Yeas and Nays were called and the fol lowing councilmen voted “Yea”: Stutz, Johnson, Crabb, Heermann and Merriman. “Nay”: None. The passage and adoption of said ordinance having been concurred in by a majority of all members elected to the Council was by the Mayor declared passed and adopt ed and the Mayor in the presence of the Council signed and approv ed said ordinance and the Clerk attested the passage and approval of same and affixed his signature thereto. Said charges shall be collected at the same time and in the same manner and enforced in the same manner as the City water charges are collected and by the same officials. Section 2. The revenues from such charges shall only be used for the abatement or the reduc tion of ad valorem taxes being levied or to be levied for the payment of bonds outstanding, or to be used for the mainten ance of existing facilities or the construction and maintenance of additions to such sewer system. Section 3. All ordinances and parts of ordinances passed and approved prior to the passage and approval of this ordinance and in conflict therewith are hereby repealed. Section 4. This ordinance shall be in full force and take effect from and after its passage, ap proval and publication according to law. Passed and approved this 15th day of November, 1955. A. RESOLUTION WHEREAS, by the provisions of Ordinance No. 226-A of the City of O’Neill, Nebraska, the City Council and Mayor are au thorized and empowered from time to time to promulgate and adopt regulations governing the use of the streets in said City and for the control of vehicular traf fic thereon, including parking, and the City Council, deeming it necessary and proper that the following rules and regulations shall be adopted, and that the same shall have the force and ef fect of law under the provisions of said Ordinance No. 226-A; _ NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF O’NEILL, NE BRASKA: 1. That the rules and regula tions herein adopted for the con trol of traffic within said City of O’Neill shall be in full force and effect from the date of adoption of this Resolution. 2. That no parking be per mitted at any time on the North side of Benton Street from a point commencing at thp North west corner of the intersection of Benton Street and Fourth Street in the City of O’Neill, |and ex tending West from said point ol beginning a distance of 450 feet. 3. That no parking be permit ted at any time on the North side of Benton Street from a point commencing at the Northeast cor ner of the intersection of Benton Street and Fourth Street in the City of O’Neill, and extending East from said point of beginning a distance of 180 feet. 4. That Article 5 of the Reso lution passed by this Council on ! May 3, 1955, be and the same hereby is repealed. 5. The goup reiterated its position that the cattle business can oper ate best without government in terference, declaring that sup ports would bring regulations and controls that go with any form of government assistance. “We ‘recognize the fact that cattle prices have been discourag ing in recent months, but we do not feel that price supports are the answer,” Mr. Coulter con cluded.
