Council Proceedings O’NEILL CITY COUNCIL o PROCEEDINGS O’Neill, Nebraska November 1, 1955 The Mayor and Council of the City of O’Neill in Holt County, Nebraska, met in the Council Chambers on the 1st day of No vember, 1955, at 8 o’clock P.M. in Regular session, the following being present: Mayor Marcellus, City Clerk French, Councilmen Crabb, Golden, Johnson and Stutz. The following were ab sent: Heermann and Merriman. A quorum being present, the fol lowing proceedings were had and done: Councilman Golden introduced an ordinance entitled: “AN ORDINANCE AUTHOR IZING THE ISSUANCE AND SALE OF WATER REVENUE BONDS OF THE CITY OF O’ NEILL OF THE PRINCIPAL AMOUNT OF EIGHT THOU SAND DOLLARS ($8,000) FOR ti~e purpose of maintain ing, EXTENDING AND EN LARGING THE WATER WORKS PLANT AND WATER SYSTEM OF THE CITY OF O’NEILL; PRESCRIBING THE FORM OF SAID BONDS AND PLEDGING AND HYPOTHECATING THE REVENUES AND EARNINGS OF THE ENTIRE WATER WORKS PLANT AND WATER SYSTEM AND ALL EXTENSIONS AND IMPROVEMENTS THEREOF FOR THE PAYMENT OF SAID BONDS AND ENTERING INTO . A CONTRACT ON BEHALF OF THE CITY WITH THE HOLD ERS OF SAID BONDS.” Said ordinance was fully and distinctly read, and on motion duly made, seconded and adopted* it was designated as Ordinance No. 293A • and the title thereof _J Councilman Johnson moved that the statutory rule requiring Ordinances to be fully add dis tinctly read on three different days be dispensed with, which motion was seconded by Coun cilman Stutz, and the Yeas and Nays being called on the passage of said motion, the following Councilmen voted “YEA”: Stutz, Johnson, Crabb and Golden The following voted “NAY : None. The motion having been concur red in by three-fourths of the Council, was declared passed and adopted, and said statutory rule suspended. Thereupon said Ordinance No. 239A was read by its title a sec ond time and was then read at large and put upon final passage. The Mayor and Council of the City of O’Neill, Nebraska, hereby find and de termine: The City owns, main 0 tains and operates its water works plant and water system and to adequately serve the city and its inhabitants it is necessary that the water works plant and water system be maintained, ex tended and enlarged; the coat of such maintenance, extension and enlargement is in excess of $8,000 and it is necessary for the city to obtain an additional $8,000 over and above the funds avail able to maintain, extend and en large its said water works plant and water system; all conditions, acts and things required by law Alice’s Beauty Shop (In Former Apparel Shop Location) Phone 263 — O'Neill to exist or to be done precedent to and in the issuance of revenue bonds do exist and have been done in due form and time as provided by law. Section 2. For the purpose of maintaining, extending and en larging the water works plant and water system owned by the City of O’Neill there shall be and there are hereby ordered issued negotiable coupon bonds of the City of O’Neill, Nebraska, to be known as “Water Revenue Bonds” of the aggregate principal amount of Eight Thousand Dol lars ($8,000) consisting of 8 bonds of $1,000 each, numbered from 1 to 8 inclusive, dated November 15, 1955, bearing interest at the rate of Two and One-half per centum (2M>%) per annum, pay able semi-annually on the fif teenth day of May and November of each year, and the principal of said bonds shall become due and payable $2,000 on the fifteenth day of November each year be ginning in 1956 and ending in 1959. Said bonds are not general obligations of the City, but shall be payable solely from the reve nues and earnings derived and to be derived from the operation of the water works plant and wa ter system of the City including all extensions and improvements thereof as provided in this ordi nance. Section 3. Said bonds shall be executed on behalf of the City by being signed by the Mayor and City Clerk and shall have the City Seal impressed on each bond. The interest coupons shall be executed on behalf of the City by being signed by the Mayor and Clerk either by affixing their own proper signatures to each coupon or causing their facsimile signatures to be affixed thereto and by executing each bond the Mayor and Clerk shall be deem ed to have adopted as their own proper signatures their facsimile blgJLldlUl CO ttUIACTi IU U1C tuupuiw pertaining to said bonds. Section 4. The said bonds and coupons shall be substantially in the following form: UNITED STATES OF AMERICA STATE OF NEBRASKA COUNTY OF HOLT WATER REVENUE BOND OF THE CITY OF O’NEILL No. $ 1,000 KNOW ALL MEN BY THESE PRESENTS: That the City of O’ Neill in the County of Holt in the State of Nebraska for value re ceived hereby promises to pay tc the bearer hereof out of the spe cial fund hereinbelow designated but not otherwise the sum of ONE THOUSAND DOLLARS in lawful money of the United States of America on the fifteenth day of November, 19.... with inter est thereon from date hereof un til paid at the rate of Two and One-half per centum (2%%) per annum, payable semi-annually on the fifteenth day of May and No vember of each year upon pre sentation and surrender of the interest coupons hereto attached as they severally become due The principal and interest of this bond is payable at the office oi the County Treasurer of Holl County in O’Neill, Nebraska. This bond is one of an issue oi eight bonds of $1000 each, num oerea irom i 10 o inclusive, o: even date and like tenor here with except as to maturity, issued by the City of O’Neill for the purpose of maintaining, extend ing and enlarging its water works plant and water system. The is suance of this bond and the othei bonds of this issue have beer lawfully authorized by ordinance duly passed, signed and publish ed by the Mayor and City Coun cil of said City in strict compli ance with Section 17-906 of the Revised Statutes of Nebraska 1943. The revenues and earnings de rived and to be derived from the operation of said water work: plant and water system and al extensions and enlargement) thereof, now owned or to be owned by the City, are pledgee for the payment of the bonds oj this issue equally and ratablj and said bonds are a first lien or all said revenues and earning: and payable solely therefrom anc are not general obligations of the City. The ordinance under whicl these bonds are issued constitute an irrevocable contract betweei the City and the holders of all o said bonds and said contract can not be changed or altered with out the written consent of the holders of seventy-five per cent um (75%) in principal amount o the bonds then outstanding, pro vided, the City reserves the righ to issue and sell additional bond: payable solely from the net reve nues of said property of :qua priority as to lien on the earning: of said property with the bond: issued under this ordinance fo: the purpose of maintaining, ex tending and enlarging its watei works plant and water system i the earnings available from th< water works and water systen during the preceding twelve months for debt service on anj bonds of this issue then outstand ing and the proposed additions bonds are equivalent to not les: than one and one-half times th( amount required for said deb service. The city agrees that it will es tablish and collect rates anc charges for water service whicl will provide revenue sufficient ii amount to pay all the costs o: maintaining and operating saic water works plant and water sys ter and to pay the principal and interest of this bond and all the other bonds of said issue as and when such interest and principal become due and will establish and maintain a special fund known as the “O’Neill Water System Fund” into which it will pay all the gross revenues col lected and received from the op eration of its said water works plant and water system and w 11 use the moneys in said Fund only for the operation and mainten ance, extension and enlargement of said water works plant and water system and for the pay ment of the interest and princi pal of said bonds as provided in said ordinance. This bond is a negotiable in strument and a holder hereof has all the rights of a holder in due course of a negotiable instrument payable to bearer. IT IS HEREBY CERTIFIED AND WARRANTED that aU con ditions, acts and things required by law to exist or to be done precedent to and in the issuance of this bond did happen, were done and performed in regular and due form and time as pro vided by law. IN WITNESS WHEREOF the Mayor and City Council have caused this bond to be executed on behalf of the City of O Neill by being signed by the Mayor and attested by the Clerk and by causing the official seal of the City to be affixed hereto and have caused the interest coupons hereto attached to be executed on behalf of the City by having af fixed thereto facsimile signatures of its Mayor and Clerk and the Mayor and Clerk do by the exe cution of this bond adopt as and for their proper signatures their respective facsimile signatures affixed to said coupons. The City hereby pledges and hypothecates the revenues and earnings derived and to be derived from the oper ation of said water works plant and water system and all ex tensions and enlargements there of for the payment of said bonds both principal and interest. Section 6. The City shall maintain and collect rates and charges for all water and water service furnished by said plant and system adequate to produce revenue and earnings sufficient at all times to (a) pro vide for the payment of interest on and principal of the bonds is sued hereunder; (b) to pay all reasonable costs of operation and maintenance of the plant and sys tem including adequate insurance as provided by this ordinance and to pay for the necessary repairs and replacements and extensions to the plant and system; (c) to establish a Bond Account as here inafter set forth. Sestion 7. The entire revenue and earnings derived and to be derived from the operation of the water works plant and water system of the City and all the i properties owned and used in ; connection therewith shall be set aside as collected and be depos ited in a separate fund which is , hereby created and shall be des ignated as the “O’Neill Water i System Fund.” The City shall set ! Up and maintain as long as any bonds are outstanding the foilow | ing accounts for the administra | tion of said Fund: : I. OPERATION AND MAIN l TENANCE ACCOUNT — The : City shall set aside in this ac [ count each month an amount ! sufficient for the proper main tenance and operation of said plant and system and the ex pense of maintenance and op eration shall be paid out of this ! account. II. BOND ACCOUNT— Be t ginning December 15, 1955 the > City will on the fifteenth day of each month up to and in L eluding April 15, 1956, transfer > to the Bond Account money » equal to one-fifth (l/5th) of all interest which will become ■ due on all bonds on the next interest payment date and on ’■ the fifteenth day of May, 1956 ( and each month thereafter a i sum equal to one-sixth (l/6th) s of all interest which will be ’ come due on all bonds on the next interest payment date, and !■ beginning December 15, 1955 • the City will on the fifteenth • day of each month up to and ! including April 15, 1956 trans fer to the Bond Account mrney equal to one-eleventh (1/1 Ith) l of all principal which will be i come due on the next maturity i date, and on the fifteenth day ! of November, 1956 and each l month thereafter a sum equal to one-twelfth (l/12th) ot all principal which will become due on the next succeeding ma turity date until all such bonds have been paid and retired. III. SURPLUS ACCOUNT.— After providing for the Opera tion and Maintenance Account and the Bond Account as above provided the surplus funds shall be set aside in a Surplus Account to be used for the extension or enlargement of the water works plant and water system or prepayment of the bonds issued under this ordinance. Section 8. At least fifteen days before such payment of principal or interest become due on any of the said bonds, the City will de posit with the County Treasurer of Holt County, Nebraska, an amou: t of money sufficient to pay the interest and principal of the bonds which will become due on such payment date, such pay ments to be made out of the Bond Account. Section 9. The City will main tain the water works plant and water system, including exten sions and improvements, in good condition and operate the same in an efficient manner and at a rea sonable cost. The City agrees with the holders, from time to time, of the bonds of this issue that the City will continue to own, free from all liens and en cumbrance, and will adequately maintain and efficiently operate a water works plant and system and the City will not create or suffer to be created any lien or charge on the revenues of said plant which shall be superior to or on a parity with the lien, charge and pledge in favor of the bonds of this issue; provided, however, the City reserves the right to issue and sell additional bonds payable solely from the net revenues of said water works plant and water system of equal priority as to lien and earnings of said plant and system with the bonds issued under this ordinance for the purpose of extending and enlarging the water works plant and water system if the earnings available from the water works plant and water system during the preceding twelve months for debt service on any bonds of this series then outstanding and the proposed additional bonds are equivalent to not less than one and one-half times the amount required for said debt service. Section 10. The City will main tain as long as any of said bonds are outstanding with reputable insurance companies insurance on said water works plant and water system of the kind and in as amount as would commonly be carried by private utilities engag ed in and operating the same or similar utility. Such insurance shall include, but not necessarily be limited to, workmen’s compen sation, public liability, fire, wind storm and comprehensive cover age. In event of any loss or damage to the water works plant or water system the proceeds which may be collected or paid on any pol icy or policies covering the same shall be used bv the Citv to re tire the bonds issued under this ordinance then outstanding or to rehabilitate said water works plant and water system. Section 11. All the water ser vice furnished to any city depart ment shall be paid for by the City at the established rates. Payment for such water servicesi shall be made quarterly from the corporate funds into the O’Neill Water System Fund created by this ordinance as revenue derived from the operation of the water works plant and system in the same manner as the other reve nue is required to be deposited. Section 12. While any bonds is sued hereunder are outstanding, the City will render bills to all customers for water service. If said bills are not paid within thirty (30) days after due water service will be discontinued. Section 13. The City will keep proper books, records and ac counts separate from all other records and accounts in which complete and correct entries will be made of all transactions relat ing to said water works plant and water system. Section 14. The holder or hold ers of ten per centum or mere of said bonds or of the coupons rep resenting interest thereon may either at law or in equity by ap propriate proceedings in any court of competent jurisdiction enforce any right created or granted by this ordinance or by the bonds issued hereunder, and if the court finds that the ap pointment of a receiver is neces sary to protect the rights of the bondholders, the court may ap point such a receiver to take over and operate the property and may fix the terms and conditions on which the same shall be operated until the default is made good. Section 15. The provisions of this ordinance shall constitute an irrevocable contract between the City of O’Neill and the holders of the bonds issued hereunder and after the issuance of said bonds no change or alteration of any kind in the provisions of this ordinance shall be made without the written consent of the holders of seventy - five per centum (75%) in principal amount of the bonds then outstanding. Section 16. The City Treasurer and the City Clerk shall be bond ed, in addition to their official bonds, by an insurance company licensed to do business in Ne braska in amounts sufficient to cover at all times all the rev enues and earnings of said water works plant and water system in their hands. Any other person employed by the City in the col lection or handling of moneys de rived from the operation of said property shall also be bonded in an amount sufficient to cover all moneys which may at any time be placed in his hands. The amount of such bonds shall be fixed by the Council, and the cost thereof shall be paid from the earnings of said water works plant and water system, and they shall secure the faithful account ing for all moneys. Section 17. The City Clerk shall make and certify in duplicate a complete transcript of the pro ceedings had and done by said City precedent to the issuance of said bonds, one of which tran scripts shall be filed with the Auditor of Public Accounts of the State of Nebraska, and the other shall be delivered to the purchas er of the bonds. After being ex ecuted by the Mayor and Clerk said bonds shall be delivered to the City Treasurer who shall be responsible under his official bond and the Treasurer shall cause said bonds to be transmit ted with a certified transcript aforesaid to the Auditor of Public Accounts of the State of Nebras ka to be registered in the Aud itors office and shall then cause the same to be registered in the office of the Clerk of Holt Coun ty, Nebraska. The City Treasur er is authorized and directed to deliver said bonds to the purchas er upon receipt of payment of the purchase price in accordance with the contract of the City with said purchaser. Section 18. If any section, par agraph, clause or provision of this ordinance shall be held invalid, the invalidity of such section, paragraph, clause or provision shall not affect any of the other provisions of this ordinance. Section 19. All ordinances, res olutions or orders, or parts here of, in conflict with the provisions of this ordinance are to the ex tent of such conflict hereby re pealed. Section 20. Motion by Golden, seconded by Suttz, that the Council advertise for bids on all gas, oil at the pump, diesel fuel and diesel oil delivered and greases and No. 1 distillate also delivered. Also oil changes and grease jobs on all city cars and equipment. Bids will be received at the council chambers on November 8, 1955 and will be in effect until May 31, 1956. Motion carried. Motion by Golden, seconded by Johnson, that George McCarthy be granted a building permit for a garage 20x30 feet, frame con struction, composition roof, lo cated on lots 6 and 7, block 1, Matthew’s addition to O’Neill. Motion carried. Motion by Crabb, seconded by Stutz, that Guy Beckwith be granted a building permit for a garage 12x26 feet to be located on lots 18 and 19, Fahy’s Park Ad dition to O’Neill. Motion carried. Motion by Johnson, seconded by Golden, that R. E. Evans be granted a building permit for a new house 24x30 feet, with a full basement. House to be completely modem. House to be located on lot 5, block E, Fahy’s Second Ad dition to O’Neill. Motion carried. The Mayor made the following appointments to the Insurance __tvK T or»H UVpH LUUUUll-wvv. *»*• --- O. Heermann. Motion by Crabb, seconded by Johnson that the Mayor’s ap pointment of Golden and Heer mann to the Insurance Committee be approved. Motion carried. Motion by Johnson, seconded by Stutz, that November 8, 1955 be set as the date of hearing for the application for On and Off Sale Beer License of John B. Graves. Also that December 6, 1955 be set as the date of hearing for the application for On and Off Sale Beer License of Wm. Belik. Motion carried. Motion by Stutz, seconded by Golden, that the Street Commit tee be given authorization to con tact the County Board of Holt County for the grading of a ditch along the county road one mile west of the State Garage Corner to be used as a drainage ditch for excess water. Goodies Make Yule Gifts By MRS. BLANCHE SPANN PEASE Christmas is just around the corner and it’s time to think of Christmas goodies, gifts and wraps. The days will go fleeting by and Christmas will be breath ing down the back of our necks and we’ll still have a million things to do. Nowadays with refrigerators and home freezers it is so much easier to do much of the Christ mas baking early in December and freeze it. The fowl to be used at Christmas can be dress ed and frozen and a lot of the last minute work we used to have to do can be done before hand. If you’re having a holiday Christmas party, you might like to make pineapple popcorn balls. They are nice for Christmas treats for the neighborhood chil dren. You can use food coloring and vary them, or wrap them in cellophane (colored) and hang hem on the Christmas tree, al lowing each visiting child to take along one popcorn ball as a gift. Some homemakers like to hide a small toy in the middle of a popcorn ball. If you do this, wrap it in waxed paper or cellophane and then shape the popcorn around it. Or shape the popcorn ball around a lollipop for pop corn treats. Peppermint or hard Christmas candy may be crushed and the popcorn balls rolled in it before they are cold. Anyway, here’s the recipe for— PINEAPPLE POPCORN BALLS One-third cup white syrup, two cups sugar, 1% cups pine apple juice, one tablespoon lemon juice, one teaspoon vanilla ex tract, few drops yellow food col oring, five quarts popped corn. Dissolve the svrup and sugar in pineapple juice and bring to a boil. Boil slowly without stirring to firm ball stage (240 to 242 de grees F.) Remove from stove, add lemon juice, vanilla and col oring. Return to stove and boil exactly one minute. Glad your folks can go and enjoy themselves as much as they do. I think it’s wonder ful when older people can go and do those kinds of things. Now that the stores are all get ting ready for Christmas so early each year, it makes one wonder if Thanksgiving will be forgotten completely one of these years. I’m sending along a recipe for date bread. The girls like sand wiches made of it in their school lunches. I keep it wrapped in foil in the refrigerator and it keeps for weeks. Also a household hint I use a lot in the winter time. Put a line from wall-to-wall over the bathtub and when drying articles of clothing that are to be dried drip, it saves a lot of wip ing up as the water drips into the tub. DATE BREAD Boil 10 minutes: Two cups dates, 2Vz cups hot water. Add three tablespoons butter to top off after you take off the fire. Cool. Cream 1 % cups sugar and two eggs together and add date mixture alternately with 3% cups flour, three teaspoons soda and % teaspoon salt sifted together. Add one teaspoon vanilla and one cup nutmeats. Bake 1% hours in 275 F. oven. MRS.
