CASE NO. 3834 ORDER Now, on this 7th day of Febru ary, A.D., 1955, this matter came on before the Court upon the pe tition of Howard Zobrist and Dol lie Zobrist, under oath, directed to this Court, alleging that on or about December 3, 1952, petition ers entered into a written contract with Orlow Colwell, now deceas ed, to purchase the Southwest Quarter of Section 33, in Town ship 35, North, Range 33, West of the 6th P.M., in Boyd County, Nebraska; that the petitioners have paid the total sum of $1, 400.00 on said contract, and that there remains past due and un paid the sum of $6,600.00 and in terest. That said contract provides that the said Orlow Colwell was to execute and deliver to petition ers a deed to said premises on March 1st, 1954. That the said Orlow Colwell in his lifetime never executed or delivered to the petitioners a deed of conveyance to said real estate, pursuant to the terms of said contract. Peti tioners pray that a day be fixed for hearing on said petition, and that notice thereof be given as provided by law, and that upon said hearing a decree be entered directing the Administrator of the Estate of Orlow Colwell, Deceas ed, for and on behalf of said estate, to execute and deliver good and sufficient deed convey ing said premises to petitioners, upon payment by petitioners of the balance due under said con tract, and interest. IT IS, THEREFORE, ORDERED that a hearing be had upon said petition in the District Court Room in the Court House at Butte, Nebraska, at the hour of 10 o’ clock A.M. on the 2nd day of March, 1955, and that notice of the pendency of this matter and of the time and place fixed for hearing thereon be given by pub lishing a copy of this order for three (3) consecutive w£eks prior to such hearing in The Frontier, a legal newspaper printed, pub lished and of general circulation in Holt County, Nebraska.
