M., in Holt bounty, Nebraska, which said oad was by action of the County 3oard of Holt County, in the year .914 declared a public road by , •eason of adverse user and pre ;cription, and Whereas it appears that a pub ic road has been used and main tained continuously on said sec ion line for more than forty years ast past, and, Whereas it further apears tnai he width of said section line •oad has never been officially es ablished, and whereas there is a jossibility that certain portions of ;aid road as previously used do lot extend a full distance of thir ;y-three feet to the north and south of said section line, and i vhereas it now appears necessary that a section line road between said sections should be officially established and declared for the full width of sixty-six feet, and extending a distance of thirty three feet to the north and south of the section line between said sections for the full distance of Dne mile east and west between said sections, and that it is neces sary in establishing said road that notice be given to the adjoining land owners in sections 30 and 31 for the purpose of permitting them to present claims for dam ages for any portions of their said lands which shall be taken in ad dition to the present road way for the purpose of widening and es tablishing said road to a full width of sixty-six feet, NOW, THEREFORE, It is here by resolved by the Board of Su pervisors of the County of Holt that a section line road be, and the same hereby is established for a distance of one mile east and west running between sections 30 and 31 in township 31 North, Range 11, west of the 6th P. M. in Hoiit County, Nebr., said roadway to be of a total width of sixty-six feet north and south, and extend ing thirty-three feet north and : jtn from the center line of the said section line between said sec tions, and, BE IT FURTHER RESOLVED that this board meet in session on the 20th day of December, 1951 at the hour of 1:30 P. M., for the purpose of hearing and al lowing claims for damages by ad jacent land owners for the exten sion of said highway beyond the present boundaries thereof to a maximum distance of thirty-three feet on each side of the section line. B IT FURTHER RESOLVED that the County Clerk give no tice to the owners of lands bound ing upon said highway of the date and place of hearing upon claims for damages, and requiring said land owners to file claims for damages, by mailing a copy of this resolution to each of the same by resistered mail at least fifteen days prior to the date of hearing above set. The pole line herein contemplat ed shall be located on the prop erty approximately as follows: Beginning at a point on the south line and one foot east of the west line of the above de scribed property, approximate ly 68 rods east and 2 rods north of the Southwest corner of the NWy» of Section 29, thence in a northerly direction approximately 20 rods to a point on the north line one foot east of the west line of the said property. The District shall also have the privilege and easement of ingress and egress across the property to ts officers and employees for any purpose necessary in connection with the construction, operation, maintenance, inspection and re moval of said line. The District shall also have the ight at any time to trim or re move such trees and under brush as may in any way endanger or interfere wth the safe operation of the lines and equipment used in connection therewith. The District shall at all times exercise all due care and dili gence to avoid injury or damage to the crops, livestock and other personal property of the Grantor, and the District shall indemnify and save harmless the Grantor from any such damage and loss arising or occurring to such prop erty solely by reason the construc tion, operation, maintenance and removal of said transmission lines. The District Agrees that should the transmission lines constructed hereunder be abandoned for a pe riod of five years, the right-of way or easement hereby secured shall then cease and terminate, and this contract shall be of no further force and effect.
