petition and application, under
oath, of Joseph Sobotka, Execu
tor of the Estate of Karolina So
botka, Deceased, praying for a
license to sell the following des
cribed real estate of the said
Karolina Sobotka, and now the
property of her said estate, to
wit:—
The Northwest Quarter of the
Northeast Quarter, the North
west Quarter, and the North
east Quarter of the South
j.vest Quarter of Section Six,
in Township Twenty-seven,
North, Range Ten, and the
West Half of the Southwest
Quarter of Section Six, Town
ship Twenty-seven, North,
Range Ten, excepting the
South sixty-five acres there
of, all West of the 6th P.M.,
in Holt County, Nebraska;
and
Lot Five, in Block Twelve,
situate in the Sub-division en
titled Blocks Twelve, Thir
teen, and Fourteen, and Out
iots Four to Eleven, inclusive,
of Outlot “B” in the Town of
Inman, Holt County, Nebras
ka,
for the purpose of paying debts
owing by said deceased and al
lowed against her said estate
and the costs and expenses in
cident to the administration of
said estate, and it appearing to
the Court from said petition
that there is not a sufficient
amount of personal property in
the possession of Joseph Sobot
ka, the Executor, belonging to
Jjaid estate to pay said debts,
ees, allowances and costs, and
that it is necessary to sell said
real estate herein described for
the payment of said debts, fees,
allowances and costs,

quired to construct one Lift
Station complete and install ap
proximately 2,100 lineal feet of
10” cast iron pipe.
Bids must be accompanied by
a certified check in the amount
of 15% of the total amount of
bid and made payable to the
City Treasurer as a guarantee
that bidder, if successful, will
execute contract and file requir
ed bonds.
Plans, specifications, and bid
ding blanks may be inspected at
the City Clerk’s Office or may
be secured from the Engineer,
Donald D. Price, 1827 South 26th
Street, Lincoln, Nebraska, on
payment of $15.00, which amount
will be returned on sets of plans
and specifications returned in
good condition by November 21,
1949.
The City Council reserves the
right to waive informalities and
irregularities and to make
awards on bids which furnish the

will in their opinion serve the
best interests of the City, or to

Council met upon call by the
Mayor.
Present Mayor Coyne, Coun
cilmen Rooney, Ray, Uhl, Hick
ey and McCarville.
Meeting called to order by
the Mayor.
Motion by Uhl, seconded by
Hickey to accept bid of Lohaus
Motor Company for a one and
one-half (%) ton Ford truck
equipped as per specification in j
the amount of $1,500.00 plus
1936 Ford truck. Roll was called
on the above motion and the
vote was as follows, aye McCar
ville, Rooney, Hickey, Uhl and
Ray, Nay none.
Motion by Rooney, seconded
by Ray to permit Irvin Sanders
to put up the hay on the City
park, and to mow around all
trees, along the highway, and
along the Sewer ditch. Motion
carried.

held on the 23rd day of August;
1949, at 7:30 P.M., there was in
troduced and placed on file the
Resolution of Necessity, Herein
after set forth, which Resolution
will be considered for passage
by said City Council at a meet
ing to be held at the regular
place of meeting of said City
Council on the 16th day of Sep
tember, 1949, at 7:30 P.M., at
which time and place owners of
property subject to assessment

Sewer to Elkhorn River.
Be it Resolved, by the Mayor
and City Council of the City of
O’Neill, Nebraska:
1. That since the present Out
fall sewer has become overload
ed and operates unsatisfactorily
causing sewage to back up into
several basements, it is deemed
advisable and necessary for
health and safety to pass this
Resolution and to make the fol
lowing improvements to the
present sanitary sewage system
in the City of O’Neill, Nebraska.'
2. That it is proposed to con
struct a diversion manhole in
existing outfall sewer immed
iately south of C & N W Rail
road on 7th street extended, di
verting raw sewage to a wet
well, pump lift station and new
outfall sewer. Diversion man
hole, wet well, pump lift sta
tion structure and equipment
are to be constructed new and
located in NE corner of the City
Park south of C & N W Railroad.

provements are to be designed
and constructed so as to form
a part of a complete sewage
treatment plant at a later date.
3. To pay the costs of said im
provements, the City shall, after
such work is completed and ac
cepted, issue its negotiable
bonds, to be known as sewer
bonds. There shall be levied an
nually upon all the taxable prop- J
erty in said city, a tax sufficient
to meet payments of interest and
principal as the bonds become
due and such levy shall bo
known as the sewer tax and
shall be payable annually in
money.
4. For the purpose of making
partial payments as the work
progresses, warrants may be, is
sued by the City Council upon
certificates of the Engineer in
charge showing the amount of
work completed and material
purchased and delivered, in the
sum not to exceed 85 per cent
of the cost thereof, which war
rants shall be redeemed and
paid upon the sale of bonds to
be issued afore-said.
5. All of the above construc
tion is to be done in accordance
with the Engineer’s plans and
specifications therefore, now on
file, which plans, specifications
and estimate of cost are hereby
apprpved and adopted and by
reference made a part hereof.
6. The Enginer’s estimate of
cost of such improvement is
$37,500.(11). . , ,, .
7. Be it further resolved that
the City Council of the City of
O’Neill, Nebraska, meet at 7:30
P. M. on the 16th of September,
1949, at their regular place of
meeting for the purpose of con
sidering objections to the pas
sage of this resolution and the
making of these improvements,
at which meeting this resolution
may be amended and passed, or
passed as proposed, or rejected.
8. Be it further resolved that
the City Clerk be and is hereby
instructed to cause notice of the
pendency of this resolution to
be published in the manner pro
vided by law and the time for
which said resolution will be
considered for passage and ob
jections heard.

be adopted. A vote thereon re
sulted as follows: Aye, Rooney,

ficial city paper as required by
law; that the date be fixed for
accepting bids on October 21,
1949 at 2:00 p.m. at the City
Council Chambers.
Roll call vote taken on said
motion resulted as follows: Aye,
Uhl, Corkle, MeCarville, Roon
ey and Hickey. Nay, none.
Whereupon the Mayor declared
such motion adopted and passed.

DELOIT—Ewald Spahn and
Mrs. Spahn, sr., are visiting
relatives in Germany. Mrs. E
wald Spahn recently returned
from New York, N- Y., after
accompaning her husband and
his father on the first leg of
their journey to Europe.
The eldest Mr. Spahn’s mot
her, who was past 90-years
old, died recently.
The relatives " the two De
loit men are visiting in Ger
many live three miles from
the nearest town with no
means of transportation.

many are scarce, the pair re
ported, and heat, washing ma
