WHERAS. it is the desire
and intention of the parties
hereto to preserve and main
tain for the public generally
and the residents of Francis
Township a privilege of travel
oveT, on and across said sec
tion 27 generally in a direct
ion from North to South and
vice versa by means of a com
monly called “Trail Road.”
NOW, THEREFORE, it is a
greed as follows:
1. That the said Henry Dob
rovolny, his heirs, successors
and assigns, shall and will per
mit the general public to trav
el over and across said section
27 generally in a direction
from North to South, without
specifically designating or lay-j
ing out any particular portion
of said premises upon which
such travel shall be had, but
Specifying that such travel
shall be by means of a Trail
Road in the most practicable
places across said land so as
to cause a minimum of dam
age to the premises consistent
with the privilege of travel.
II. That in conjunction wiui
the right to travel across said
land, there is hereby also
granted by the said Henry
Dobrovolny a right and privil
ege to the public to travel oyer
and across said bridge traversing
Holt Creek in the Southeast
Quarter of said section.
III. It is further stipulated
and agreed between the part
ies that the primary responsi
bility for the care and up
keep of said bridge rest upon
the said Henry Dobrovolny
who is the owner thereof; but
that if for any reason said
bridge is not kept in a reason
able and ordinary condition to
permit normal traffic and trav
el thereon, that in that event
the said Township of Francis
or any resident therein having
occasion to use said road and
bridge, shall have the right to
do all things reasonable nec
essary to maintain and keep
said bridge and the approach
es thereto in a reasonable state
of repair to enable t r a v.e 1
thereon, which said cost of
maintenance or repair if per
formed by the said Francis
Township or other person
shall be at their or its own ex
pence without charge upon

IV. It is further specified
and agreed between the part
ies that there is an auto gate
now situated on the South end
of said road, and that the
Township of Francis agrees to
purchase and furnish another
auto gate to be placed approx
imately in the middle of said
road toward the center of the

auto gates along said road
wherever the same may be
necessary and at the entrances
and exits of said road.
V. It is further specified that
this agreement shall be con
strued to create a privilege
only of travel over and across
said Section 27, and shall not
be construed to vest the title
to any of said premises in the
Township of public generally,
and that the title and owner
ship off said land shall remain ,
at all times in the said Henry
Dobrovolny; that it is futher
understood that any and all
persons having occasion t o
travel over said road and I
bridge shall do so in a law ;
abiding manner without com
mitting any acts of vandalism, 1
lawlessness and without unnec
essary damage or destruction
to thie premises or property of
Henry Dobrovolny.

ceived was from the Fehr
Tractor & Equt. Co. of Omaha,
Nebr.
The road Committee opened
and reviewed the bid. After
consideration motion was made
by Borg, seconded by Hubbard
that this bid be rejected and i
their certified check be re
turned to them. This will per
mit the Board to go out on
the open market to purchase
machinery’ for their use, when
ever they can buy to best ad
vantage.
The balance of the afternoon
was spent working on the
Budget.

Sulentic Co. decide that they

1:30 This was the time set
for the hearing on the Road
Petition of S. R. Robertson &
others. Eleven persons appear
ed before the Board at this
hearing. The matter was dis
cussed but no decision being
reached, motion was made by
Borg, seconded by Frickel that
action on this petition be de
ferred for futher investigation.
Carried.
2:30 This was the time set
for the hearing of Sojka’s road
petition. Three men appeared.
After discussion motion was
made by Cronk, seconded by
Borg that the prayer of these
petitioners be granted and this
road be designated a County
road on condition that the
people and township, who
have furnished help and mon
ey before will continue to do
the same after the County
takes it over. Carried

checking it was found an error
had been made in totaling his
