RESOLUTION OF NECESSITY
For Construction of Sanitary
Sewer Extensions
Notice is hereby given that at a
meeting of the City Council of the
City of O'Neill, Nebraska, held on
the 12th day of August, 1946, at
7:30 p.m., there was introduced
and placed on file, the Resolution
of Necessity, Hereinafter set
forth, which Resolution will be
considered for passage by said
City Council at a meeting to be
held at the regular meeting place
of said City Council on the 6th day
of September, 1946 at 7:30 p.m.,
at which time and place owners of
property subject to assessment for
the cost of the improvements con
templated by said Resolution, may
appear and make objections, if any
they have, to said work, or to the
passage of said resolution, at
which time said Resolution mav be
amended and passed, or passed as
proposed, or rejected.
Councilman Corkle offered the
following resolution and moved
that it be proposed for passage at
the meeting to be held September
6th, 1946 at 8:00 p.m.
RESOLUTION OF NECESSITY
FOR CONSTRUCTION OF
SANITARY SEWER
EXTENSIONS
HE IT RESOLVED, by the
Mayor and City Council of the
City of O’Neill, Nebraska:
1. That it is deemed advisable
and necessary due to the growth
of the City and for health and
safety to pass this Resolution and
to make the following improve
ments to the present sanitary
sewage system in the City of
O’Neill, Nebraska.
2. That it is proposed to con
struct the following extensions to
the present sanitary sewer system:
Hancock Street (Jefferson to
75 ft. ea.st of 2nd and Han

across C.&N.W. right-of
way to center line of 3rd
St. and north property line
of C.&N.W. right-of-way
and 7th to 10th St.);
C.&N.W. Right-of-Way (3rd
to 7th);
Grant Street (8th to 10th);
Fremont Street (Harrison to
Madison and 7th to 10th);
Everett Street (Harrison to
alley between Harrison and
Jefferson and 7th to 10th);
Alley between Clay and Doug
las (Harrison to Madison);
Clay Street (6th to 10th);
Benton Street (Jefferson to
Madison);
Adams Street (Madison to
1st);
John Street (4th to 7th);
Harrison Street (Fremont to
alley between Clay and
Douglas);
Jefferson Street (Fremont to
alley between Everett and
Douglas);
Madison Street (Grant to Fre
mont and 106 feet south of
Douglas to Adams);
Third Street (C.&N.W. Right
of-Way to Douglas and
Adams to John);
Sixth Street (Fremont to Clay
and Adams to John);
Eierhth Street (Clav to Ben
ton);
That such construction shall be
of vitrified clay pipe or cement
concrete pipe of eight and ten-inch
sizes.
3. To pay the cost of said im
provements, the City shall, after
such work is completed and ac
cepted, issue its negotiable bonds,
to be known as sewer bonds.
There shall be levied annually up
on all the taxable property in said
City, a tax sufficient to meet pay
ments of interest and principal as
the bonds become due and such
levy shall be known as the sewer
tax and shall be payable annually
in money.
4. For the purpose of making
partial payments as the work
progresses, warrants may be
issued by the City Council upon
certificates of the Engineer in
charge showing the amount of
work completed and material pur
chased and delivered, in the sum
not to exceed 85% of the cost
thereof, which warrants shall be
redeemed and paid upon the sale of
bonds to be issued aforesaid.
5. All of the above construction
:s to be done in accordance with
the Engineer’s plans and specifica
tions therefore, now on file, which
plans, specifications and estimate
of cost are hereby approved and
adopted and by reference made a
part hereof.
6. Engineer’s estimate of cost
of such improvements is $65,221.00.
7. Be it further resolved that
the City Council of the City of
O’Neill, Nebraska, meet at 7:30!
p.m., on the 6th day of September, \
1946, at their regular place of!
meeting for the purpose of consid
ering objections to the passage of
this resolution and the making of
these improvements, at wnich!
meeting this resolution may be
amended and passed, or passed as
proposed, or rejected.
8. Be it further resolved that
the City Clerk be and is hereby
instructed to cause notice of the
pendency of this resolution to be
published in the manner provided
by law and the time for which said
resolution will be considered for
passage and objections heard.

mately 4,700 lineal feet of 10-inch
and 16,000 lineal feet of 8-inch
sanitary sewer extensions and ap
proximately 58 manholes.
Bids must be accompanied by a
certified check in the amount of
1591 of the total amount of bid and
made payable to the City Treasur
er as a guarantee that bidder if
successful, will execute contract
and file required bonds.
Plans, specifications, and bid
ding blanks may be inspected at
the City Clerk’s Office or may be
secured from the Engineer, Donald
D. Price, 1827 South 26th Street,
Lincoln, Nebraska, on payment of
$15.00, which amount will be re
turned on sets of plans and speci
fications returned in good condi
tion within fifteen days after re
ceipt of bids.
The City reserves the right to
waive informalities and irregu
larities and to make awards on
bids which furnish the material
and construction that will in their
opinion serve the best interests of
the City, or, to reject any or all
bids. Engineer’s estimate of cost
