having derived title thereto by
mesne conveyances from the heir
of the deceased Alvin Porter.
That the prayer of said petition
is that the Court may find and
determine the time of the death
of the decedent, Alvin Porter;
that Alvin Porter and Alvan
Nash Porter were one and the
same person; that he died intest
ate a resident and citizen of Holt
County, Nebraska; may find and
determine who are his heirs and
their degree of kinship; may find
and determine the right of descent
of the real property of which he
died seized; that further admin
istration of this said estate may
be dispensed with; that there is
no inheritance tax, state or fed
eral, due from this said estate or
the heirs thereof, and that there
are no debts against said estate,
and that the claims of all cred
itors are barred, and for such
other and further relief as may
be just and equitable.
That said matter is set for
hearing before the County Court
of Holt County, Nebraska, in the
County Court Room in the Court
House in the City of O’Neill,
Nebraska, on the 17th day of

Administrator of the Estate of

directed to the District Court of

it is alleged that in his lifetime
the said John E. Summerer,
Deceased, and J. W. Walter, by
written contract agreed to sell
and convey, and one Willard E.
Rickard agreed to purchase, the
West Half of Section Nine (9),
and the Northeast Quarter of
Section Eight (8), all in Township
Twenty-five (25), North, Range
Twelve (12), West of the 6th P.
M., in Holt County, Nebraska,
for the sum of $6,000.00, payable
at the times and in the manner
set forth in said petition and in
said written contract, dated June
1, 1943, a copy of which is at
tached to and made a part of said
petition; that said real estate was
then owned by the said John E.
Summerer and J W. Walter as
tenants in common. Said Ad
ministrator prays for specific
performance of said Contract;
that defendant Willard E. Rick
ard be required to complete the
same and pay the balance due
thereon; that petitioner, as such
Administrator, be authorized and
directed to make, execute and
deliver to the said Willard E.
Rickard a good and sufficient
warranty deed of conveyance,
conveying all of the interest of

That petitioner, Oscar W. Peter
sen, is a son of Arnette Peter
sen and Peter J. Petersen, both
deceased, and is the present owner
of the real estate above described,
havng acquired title thereto by
inheritance from his father and
mother and by quit claim deed
from his brothers and sisters;
that the prayer of his petition is
that the Court may find and de
termine the time of the death of
both Arnette Petersen and Peter
J. Petersen; that they both died
intestate, residents and citizens of
Holt County, Nebraska; may find
and determine who are their heirs
and fix their degree of kinship;

for the construction of one 16x32
foot 15-ton wood bridge, located
in Section 26, Township 33, Range
12, and the (urnishin of material
in connection therewith at a
specified sum per lineal foot for
all piling used in the substructure,
and specified sum per lineal foot
for the supe structure, all in ac
cordance with plans and speci
fications provided by Depart
ment of Roadi and Irrigation
State of Nebraska, now on file
in the office of County Clerk of
Holt County. Said bid must be
submitted on bidding blanks fur
nished by the Department of
