Daisy Howe Umberger filed her
petition in the above matter set
ting forth among other things that
James M. Brown, a resident, citi
zen and inhabitant of Wythe
County, Virginia, died intestate
in the month of May, 1913, seized
and possessed in fee simple, un
der the name of J. M. Brown, of
The East Half, and the
Southwest Quarter, of Sec
tion 31, Township 26, Range
13; the East Half of Section
6, Township 25, Range 13; the
South Half of the Northeast
Quarter; the Northwest Quar
ter of the Southeast Quarter,
and the Southeast Quarter of
the Northwest Quarter, of
Section 1, Township 25, Range
14, West of the 6th P. M., in
Holt County, Nebraska;
that he left him surviving as his
sole and only heir at law his sis
ter, Alice Brown Howe; that peti
tioner, Daisy Howe Umberger, is a
daughter and heir at law of Alice
Brown Howe, now also deceased,
and derived title to an undivided
one-half interest in and to said
real estate by inheritance from
her mother, and is now the owner
of an undivided one-half interest
in said real property; that the
prayer of said petition is that the
Court may find and determine the
time of the death of the said James
M. Brown, Deceased; that he died
intestate a resident, inhabitant
and citizen of Wythe County, Vir
ginia; may find and determine
who are his heirs, and fix their
degree of kinship; may find and
determine the right of descent of
the real estate belonging to said
deceased; may find and determine
that the deceased held title to
said property as J. M. Brown;
that further administration of
this estate may be dispensed with;
that there are no debts against
said estate, and that the claims
of all creditors are barred; that
there is no inheritance tax, state
or federal, due from this estate
or any of the heirs thereof; and
for such other and further relief
as may be just and equitable.
That said matter is set for hear
ing before the County Court of
Holt County, Nebraska, in the
County Court room of the Court
House in the City of O’Neill, on
the 30th day of September, A. D.,
1943, at the hour of 10 o’clock A.
M.; that if you fail to appear at
said time and place to contest
said petition the Court may grant
the prayer thereof.
