Nebraska Liquor Control. Com
mission Beer Distributor's Licenses,
and
Whereas, they have paid to the
City Clerk of O’Neill, Nebraska,
the occupation tax required by Or
dinance of the City oi O’Neill,
Nebraska,
Therefore be it resolved by the
Mayor and City Council of O’Neill,
Nebraska, that L . M. Merriman
and Emma Merriman dba Merri
Beverage Co., and J. M. Gatz, dba
Gatz Bros, be and they are hereby
granted a license for Beer Dis
tributors within the City of O’Neill,
Nebraska, and be it further re
solved that the Mayor and City

called on the above motion and the

The following resolution was in
troduced by Miles and read:

Whereas, P. B. Harty, has made
application for a Class C. Alco
holic Liquor License, and
Whereas, said application is in
all respects, in legal and due form
and notice of hearing thereon has
been given according to law by
publication in the Frontier, and,
Whereas, no remonstrances are
interposed, and no objections are
on file or made to the granting of
said application and the issuance of
license thereon, and
Whereas, a majority of the City
Council of O’Neill, Nebraska, fa
vor the issuance of a Class C. Re
tail Alcoholic Liquor License to
said applicant,
Therefore, be it resolved by the
Mayor and City Council of the city
of O’Neill, Nebraska, that a Class
C. Retail Alcoholic Liquor License
be granted to said P. B. Harty, and
that the City Clerk be and he here
by is directed to issue said license,
in manner, form and within the
time perscribed by law.
Motion by Uhl, seconded by Mc
Nally that the above resolution be
adopted. Roll was called on thej
above motion and the vote thereon
was as follows: Aye, Miles, Uhl,
Phalin. Lindberg, Yantzi, McNally.
Nay, None.
Motion by Lindberg, seconded by
Yantzi, that the Mayor be instruct
ed to endorse the approval on ap
plicants bond. Roll was called on
the above motion and the vote
thereon was as follows: Aye, Miles,
Uhl, Phalin, Yantzi, Lindberg, Mc
Nally. Nay, None.
Motion by Miles, seconded by
McNally, that the Council vote by
ballott on the Class C. Alcoholic
Liquor application of R. L. Tom
linson, M. L. Wyant, R. W. McEl
vain, and W. E. Gatz, and that the
two receiving the majority of the
votes of the Council receive the Li
censes. Motion carried.
The result ot the nrst bailor be

son, (3) Three, Wyant, (2) Two,
Gatz, (3) Three, McElvain being
the only one to receive a majority
of the Council votes, and there be
ing a tie of Three votes for the
next high, another ballot was tak
en by the council to decide the next
applicant to receive a license, the
result of this ballot being, Tom
linson, (3) Three, Wyant, (1) One,
Gatz, (2) Two. There being no
applicant receiving a majority of
the votes of the Council another
ballot was taken, the result of this
ballot being Tomlinson, (3) Three,
Wyant (1) One, Gatz, (2) Two.
Still resulting in no applicant re
ceiving a majority another ballot
was taken, the result being Tom
linson. (3) Three, Wyant (1) One,
Gatz, (2) Two. No applicant re
ceiving a majority of the Council
votes*
Motion by Miles, seconded by
McNally, that the above motion be
amended to read that any one of
the applicants receiving a major
ity of the Council votes be grant
ed an Alcoholic Liquor License
Class C. Motion carried.
Motion by Uhl, seconded by
Phalin, that the Council vote on
the application of Ralph W. Me
Elvain, for a Class C. Alcoholic
Liquor License. Roll was called
on the above motion and the vote
thereon was as follows: Aye, Miles,
Uhl, Phalin, Lindberg, McNally;
Nay, Yantzi.
The following resolution was in
troduced by McNally, and read:
Whereas, Ralph W. McElvain,
has made application for a Class C.
Alcoholic Liquor License, and
Whereas, said application is in
all respects, in legal and due form
and notice of hearing has been
given according to law by publica-j
tion in the Frontier, and
Whereas, no remonstrances are
interposed, and no objections are
on file or made to the granting of
said application and the issuance
of license thereon, and
Whereas, a majority of the City
Council of O’Neill, Nebraska, favor
the issuance of a Class C. Alcoholic
Liquor License to said applicant,
Therefore, be it resolved by the
Mayor and City Council of O’Neill,
Nebraska, that a Class C. Alcoholic
Liquor License, be granted to said
Ralph W. McElvain. and that the
City Clerk be and he hereby is di
rected to issue said license, in man
ner, form and within the time pres
cribed by law. . . .

Miles, that the Mayor be instructed
to endoirse the approval on appli
cant’s bond. Roll was called on
the above motion and the vote

Motion by Phalin, Seconded by
Uhl. that the resolution passed by
the City Council on February 9th,
1940, be amended by striking out
reference to the sum of $2100.00 in
the Gasoline Tax Fund mentioned
therein. Motion carried.

Beer retailing is a privilege conferred only by ’
a license. And it is important to every citizen
that this licensed privilege not be abused.
To safeguard this privilege, the Nebraska Brew
ers arjd Beer Distributors Committee employs
a field representative to make reports on the
operation of retail beer outlets. These reports
show that the great majority of establishments
are operated in the public interest. Only a few
abuse their licenses, thereby jeopardizing the
state's annual tax revenue of approximately
$500,000 and the nearly $2,000,000 in Nebraska
wages derived from the manufacture and sale
of beer every year.
The brewing industry will continue to co
operate with the legal authorities to weed out
these few and thus keep beer retailing as
wholesome as beer itself.

Council met pursuant to the fol
lowing call:
TO THE MEMBERS OF THE
CITY COUNCIL OF O’NEILL,
NEBRASKA
You and each of you are hereby
notified that there will be a meet
ing of the city council of O’Neill,
Nebraska, at the Council Cham
bers of said city Friday evening,
April 26th, 1940, at the hour of
8 o’clock. The purpose for which
this meeting is called is the trans
action of the following items of
business.
First, the negotiation of a lease
and option to purchase a road
grader machine for said city. Sec
ond, to pass on the application of
the New Deal Oil Company for
permission to install three addi
tional street light poles and lamps
at their place of business on Doug
las street. Third, to adopt a reso
lution approving a lease held by
Lod Janousek on a different loca
tion than that specified in his ap
plication for a beer license for the
Seriod from August 22nd, 1940 to
lay 1, 1941, for the operation of
a beer parlor in the premises cover
ed by said lease.

The matter of the request of
the New Deal Oil Co. was deferred
for the reason that they had no
written application for the per
mission to install three street
lights, and the Clerk was instruct
ed to notify them to make their
request in writing.
