CITY COUNCIL PROCEEDINGS O’Neill, Nebr., May 2, 1939 The City Council met in regular sesion. NORTHWESTERN BELL TELEPHONE COMPANY Motion by Yantzi, Seconded by Lindberg, that the bonds of the following elected officials be ap proved: Frank Phalin, Council man First Ward; G. E. Miles, Councilman Second Ward; Norbert Uhl, Councilman Third Ward. The motion carried. A. E. Bowen met with the Coun cil in regard to a sidewalk on First and Hancock streets. The Mayor left the matter to t h e sidewalk committee. On motion the Council adjourn ed sine die. C. W. PORTER City Clerk. O'Neill, Nebr., May 2, 1939. The new Council met and organ ized. Present, Mayor Coyne, Councilman Miles, Uhl, Yantzie, Lindberg, McNally and Phalin. The Mayor made the following appointments: City Attorney, James P. Marron. Chief of Police and Pound master, T. J. Coyne. Assistant Police, Chester Calkins Engineer at Pump House, Jesse Scofield. Medical Advisor, Dr. L. A. Carter Street Commissioner, Norbert Uhl. The following committees were appointed for the ensuing year: Streets and Alleys—Uhl, Yantzi, Miles. Lights—Lindberg, McNally,Pha lin. Water—Phalin, Uhl, Miles. Sewers—McNaly, Phalin, Lind bergh Walks and Crossings—Miles, Yantzi, McNally. Parks and Grounds—McNally, Lindberg, Yantzi. Auditors of Bills and C'laints— Uhl, Phalin, Lindberg. Finance Committee—Miles, Pha lin. Cusstodian of Public Property— Yantzi. Motion by Miles, seconded by Uhl, that the appointments and Committees as made by the Mayor be confirmed. Carried. Motion by Lindberg, Seconded by Phalin, that The Frontier be des ignated as the official paper for the next ensuing year. Carried. Motion by Miles, Seconded by McNally, that Uhl be appointed as Chairman of the Council. Carried. Motion by Miles, seconded by Uhl, that the water rates be re duced for the second and third quarters of 1939 for residential properties to a minimum of $3.00 for the first 10,000, and ten cents (10c) a 1,000 thereafter. Motion carried Motion by Uhl, Seconded by Yantzi, that the date of hearing on the Alcohol liquor licenses of Richard L. Tomlinson and W. M. Gatz be set os of May 8, 1939, at 7 p. m. Motiorf carried. Motion by Uhl, Seconded by Phalin, that the Council decline the revision of the City Ordinances, as offered by Paul Haberlin. Motion carried. Upon motion Council adjourned to Monday evening, May 8, at 7 p. m. Motion carried. C. W. PORTER, City Clerk. O’Neill, Nebr., May 8, 1939. Council met as per adjournment of May 2, 1939. Present, Mayor Coyne, Councilman, Uhl, Phalin, Miles, Yantzi, Lindberg. The meeting was called to order by the Mayor. Motion by Phalin, Seconded by Yantzi, that the Council vote by ballot on the application for an al cholic Liquor license of Richard L. Tomlinson and W. E. Gatz. The above motion was withdrawn by Phalin. Motion by McNally, Seconded by Yantzi, that the Council vote by ballot on the granting of the appli cation of Richard L. Tomlinson, for a Class C. Alcholic Liquor license, vote yes or no. Motion carried. The result of the vote by ballot was as follows: Yes: l-l-l-l (4). No: 1-1- (2). Tha following resolution was in troduced by Phalin and read: RESOLUTION Whereas, Heretofore the appli cation of E. P. Peterson has been granted for a Class C Alcholic Liquor License, and Whereas, the City Council has on this date approved the appli cation of Richard L. Tomlinson for a Class C. Alcholic Liquor License, and, Whereas, the said E. F, Peterson has notified the City Council and the State Liquor Commission that he does not wish a license as above described in the event that such a license is granted to the said Rich ard L. Tomlinson, Now, therefore, Be it resolved by the Mayor and City Council of O’Neill, Nebraska, that the appli cation of E. F, Peterson for a Class C. Alcoholic Liquor License heretofore approved by said Coun cil be and the same is hereby re sinded, revoked and cancelled. Motion by Lindberg, Seconded by McNally, that the above reso lution be adopted. Roll was called on the above motion and the vote thereon was as follows: Aye: Yantzi, Lindberg, McNally, Uhl, Miles, Phalin. Nays: None. Motion by Yantzi, Seconded by Phalin, that the Mayor endorse the approval on Richard L. Tom linson's bond. Roll was called on the above motion and the vote fhereon was as follows: Aye: Yantzi, Lindberg, McNally, Uhl, Phalin, Miles. Nay: None. The following resolution was in troduced by Lindberg and read: Kr.SOLl 1 ION Whereas, Richard L. Tomlinson has made application for a Class C. Alcholic Liquor License, and Whereas, said application is in all respects, in legal and due form and notice of hearing thereon hav ing been given according to law by publication in The Frontier, and Whereas, no remonstrances ur<* interposed, and no objections are on file or made to the granting of said application and the issuance of said license thereon, and Whereas, a majority of the City Council of O’Neill, Nebraska, favor the issuance of a Class C. Liquor License, Retail, to said applicant, Therefore, be it resolved by the Mayor and City Council of O’Neill, Nebraska, that a Class C. Retail Alcholic License be granted to said Richard L. Tomlinson, and that the City Clerk be and he hereby is directed to issue said license, in manner, form and within the time prescribed by law. Motion by McNally, Seconded by Yantzi that the above resolu tion be adopted. Roll was called on the above resolution and the vote thereon was as follows: Aye: Yantzi, Lindberg, McNally, Uhl, Phalin, Miles. Nay: None. Stout, of O’Neill, Nebraska, has made appli cation to the Nebraska Liquor Control Commission, for a retailers license to sell within the City of O’Neill, Nebraska, Alcholic Liquors in Original Package, and Whereas, said Commission has forwarded to the City of O’Neill, said application, and Whepeas, there are no objections or complaints on file with the City Clerk of said City. Therefore, be it resolved by the Mayor and City Council of O’Neill, Nebraska, that the City Clerk for ward a copy of these resolutions to the Commission. Be it further resolved, that there are no objections or complaints on file against said license. Be it further resolved, that the City of O’Neill, Nebraska, file no objections against the issuance of said license. Motion by Miles, Seconded by Uhl, that the above resolution be adopted. Roll was called on the above motion and was as follows. Aye: Lindberg, Yantai, McNally, Uhl, Phalin, Miles. Nay: None. Motion by McNally, Seconded by Yantai, that the Council vote by ballot on the application of W. E. Gatz for a Class C. Al cholic Liquor License, vote yes or no. The meeting was called to order by the Mayor. The Council took up the matter of preparing the “Estimate of Ex penses” for the ensuing year. Upon motion the Council ad journed subject to the call of the Mayor. C. W. PORTER, City Clerk. BUSY HOUR CLUB The Busy Hour Club gathered at the home of Mrs. J. P. Miler, Thurs day, May 25. All members were present, and also three visitors. Mrs. Claude Johnson, of O’Neill, Mrs. Lizzie Pelcer, of Atkinson, and Miss Gladys Schmohr, of Em met. Each guest embroidered a tea towel for the hostess. Games were played and Mrs. Ruby was the prize winner. A birthday gift had been hidden away for Mrs. L. O. Johnson, whirls took considerable time to find, but. when finally found was high up in the roof. Lunch was served at 4 p. m. and w’e voted to meet with Mrs. Ruby Wayman on June 29.
