Cronin, Attorney ORDINANCE NO. 162-A An Ordinance creating Paving Dis trict No. 3, in the City of O’Neill, Nebraska: Defining its limits and boundaries, and providing for the improvement of certain streets in said district by grad ing, curbing, guttering, draining and paving, describing the prop erty especially benefitted by said improvements, and providing for plans, specifications and esti mates of costs thereof, and se curing bids and letting contracts for the construction of said im provements, and providing for the cost thereof, and for the is suance of Intersection Bonds of said City, to pay the cost of im proving the intersections an^ areas formed by crossing of streets and alleys in said Dis trict, and for the issuance of Dis trict Paving Bonds, to pay the costs of improving said streets exclusive of said intersections in areas aforesaid and for the mak ing of special assessments against the property especially benefited by said improvements, and for a sinking fund to pay all of said paving bonds, and for the issu ance of temporary warrants as the work progresses. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF O’NEILL, NEBRASKA: ' Section 1. There is hereby cre ated in the City of O’Neill, Ne braska, in the County of Holt a street improvement District to be known and designated as Paving District No. 3, of the City of O’Neill, Nebraska. f Section 2. Said Paving District No. 3 of the City of 0 Neill, Ne braska, shall and the same does hereby comprise all the territory lying and being within the follow ing boundaries* Beginning at the South West Corner of Lot 21, in Block 16 in the Original town of O’Neill, and running thence North parallel to and 180 feet West of the West line of Fourth Street, to the North line of Benton Street, thence East along the North line of Benton Street to a point 180 feet East of the East line of Fourth Street, thence South parallel to and 180 feet East bf the East line of Fourth Street, to the Southeast Corner of Lot 21, Block 15, in the Original town of O’Neill, Nebraska, thence West along the North line of Douglas Stbeet to place of beginning. Section 3. The following street within Puving District No. 3, shall be, and hereby are ordered improv ed by grading, draining, curbing, guttering and paving the same to wit: Fourth Street from the North line of Douglus Street to the North line of Benton Street. 1 Section 4. The widths to be paved on road ways between the curbs of said street shall be as follows, from the North line of Douglas Street to the North line of Clay Street to be 68 feet wide; from the North line of Clay Street to the North line of Benton Street to be 68 feet wide. Section 6. All of said draining, grading, curbing, guttering and paving shall be constructed to the established grades as fixed by the Ordinances of said city and the center line of said paving shall be the center of said respective streets. Section 6. The Special Engi neers employed by the City, shall make detailed plans and specifi cations for said improvements and an estimate of the cost thereof, and shall submit the same to the City Council of O’Neill, Nebraska, and upon the approval of the same by the City Council bids for the construction of i said work shall be invited by advertisement. In ad vertising for bids for any such work, the amount of the engineers estimate of cost shall be published therewith. Upon acceptance of any bids therefor the Mayor of O’Neill, Nebraska, is authorized to enter into a contract on behalf of the City for such work, and the City Clerk shall attest the execu tion of said contract, and attach the City Seal thereto. The City Council shall have the right of re jecting any and all bids. Section 7. The cost of grading, curbing, guttering, paving and draining the intersections andareas formed by the crossing of streets ajid alleys, including all expenses incidental thereto, shall be paid by issuing and selling Intersection Paving Bonds of the City of O’Neill Nebraska, as authorized by the Statute and the City Council shall levy annually a tax upon all tax able property within the city of O’Neill, Nebraska, sufficient to pay the principal and interest of said intersection bonds at the time same shall become due. The cost of grading, curbing; guttering, paving and draining 3aid streets exclusive of the intersec tions and areas formed by the cros sing of streets and alleys, including all expenses incidental thereto, shall be assessed against the lots and parcels of real estate in said paving district abutting upon or adjacent to such highways and streets od especially benefited there by in proportion to 3uch benefits and not in excess of such benefits on the cost of such improvements. For the purpose of paying the cost of grading, curbing, guttering, paving and draining said streets exclusive of intersections and areas formed by the crossing of streets and alleys and all expenses inci dental thereto, the City Council shall, after the completion of the work, cause to be issued bonds of the City of O’Neill, Nebraska, to be called District Paving Bonds, District No. 3. The special taxes and assess ments levied upon the property es pecially benefited as aforesaid when paid shall constitute a sinking fund for the payment of said District Paving Bonds and the interest thereon. Section 8. For the purpose of making partial payments as the work progresses warrants shall be issued by the City of O’Neill, Ne braska, upon certificates of the Special Engineers in charge, show ing the amount of work completed in a sum of 80 per cent of the total thereof, which warrants shall be redeemed and paid upon the sale of bonds as aforesaid. Section 9. This Ordinance shall take effect and be in force from and after its passage, approval and publication as provided by law. Passed and approved this 7th day of August, 1935. Mr. and Mrs. Ralph Bowering and daughter, Millicent, of near Oportunity, were visiting and shop ping here last Saturday. R. H. Wunner, son of Mr. and Mrs. J. H. Wunner, of Ewing, has moved to Tilden where he opened an office for the practice of law. Clayton 0. Miller, of Norfolk, and Miss Dorothy L. Reiken, of O’Neill, were granted a marriage license in county court Wednesday. The infant son of Mr. and Mrs. Ambrose Slattery died last Mon day at the age of two days and was buried in Calvary cemetery last Tuesday. Mr. and Mrs. George Van Eevery and children, Marvin, Laverne and Dean, visited Sunday at the home of Mr. and Mrs. 0. 0. Bradley at Ainsworth. Mrs. John Vanderlinden and children, Junior, Donna and Willa, left Wednesday for Hartington for several days visit ther with rela tives and friends. A prominent O’Neill democrat, on being asked Thursday morning if he had heard from Rhode Island, replied, “It is not a part of the Union any more.’’ Major Francis Brennan and sis ter, Miss Bernadette, returned last Friday from a short visit to Chi cago. They were accompanied by Mr. and Mrs. Emmet Doyle, who are visiting relatives and friends here. George A. Melvin Pilger, of this city, and Miss Nila Renner, Dorsey, were granted a mariage license in the county court last Thursday, and were married at the Methodist church by Rev. A. J. May. Mr. and Mrs. Roy Garroll and little daughter returned last Fri day from Lincoln, where Superin tendent Carroll has been taking a special course at the State Univer sity for the past six weeks. James M. Platt and Miss Ber nice R. Smith, both of Chambers, were granted a marriage license in county court last Saturday. Mayor and Mrs. Kersenbrock and children visited relatives in Os mond last Sunday.
