Frank Peter spent the week-end
with his folks, Mr. and Mrs. John
Peter Jr. and returned to school Mon
day.
Well, it won’t be long till we’ll all
hang up our stocking and wonder
what old Santa is going to bring us.
Let’s hope none of us are disappoint
ed to find it empty, as it might lower
our belief; for some of us still believe
that there is a Santa Claus. Don't

Zoreda D. DeWitt, filed her amended
petition herein, the object and prayer
of which are to secure a decree of
Court quieting and confirming in the
plaintiff the title to the following des
cribed premises situate in Holt Coun
ty, Nebraska, to-wit:
The East Half of the Northwest
Quarter, and the East Half of the
Southwest Quarter, of Section Elev
en, in Township Thirty-two, North of
Range Eleven, West of the Sixth
Principal Meridian in Holt County,
Nebraska; and the Northwest Quar
ter of the Southeast Quarter of Sec
tion Ten; and the West Half of the
Northwest Quarter, and the North
west Quarter of the Southwest Quar
ter of Section Eleven, in Township
Thirty-two, North of Range Eleven,
West of the Sixth Principal Meridian
in Holt County, Nebraska.
Plaintiff in her amended petition
alleges:
That the defendant, David Adams,
at one time had a tax deed upon the
northeast quarter of the southeast
quarter of section ten; but it was en
tirely invalid; and all causes of ac
tion thereon have long since been
barred by the statute of limitations;
and there is no longer any lien there
by upon said premises.
That the defendant, Mary A. Dwy
er, at one time had an invalid tax
deed upon the west half of the north
west quarter and the northwest quar
ter of the southwest quarter of said
section eleven but all rights there
under have been barred by the law of
limitations for more than twenty
years last past; and the tax claim of
the said Adams has been barred by
the law of limitations for more than
twenty years last past; and that
there is no lien whatsoever on said
premises possessed by any of the de
fendants herein; but their assertion
of some lien upon, or interest in, said
premises casts a cloud upon the title
of this plaintiff to said premises, and
depreciates the value thereof. That
the defendants are all non-residents
of the State of Nebraska. That none
of the defendants has any title to
said premises or any part thereof.
That there are persons who claim
or appear to have some interest
in, rights or title to or lien upon the
aforesaid premises and the owner
ship of interest in, rights or title to,
or lien upon such property of such
persons does not appear of record in
or by their respective names in the
County of Holt in the State of Ne
braska; and that the plaintiff. after
diligent investigation and inquiry is
unable to ascertain and does not
know the names or whereabouts or
the residence of such persons but
that all of such persons are non-resi
dents of the State of Nebraska.
That all the defendants claim or
appear to have some interest in,
rights or title to or lien upon said
premises.
That defendant, H. S. Ballou &
Company claim some interest in and
lien upon the east half of the north*
west quarter and the east half of the
southwest quarter of section eleven,
township thirty-two, range eleven,
west of the sixth principal meridian *
by reason of one certain mortgage
for the sum of $100.00 given by Wil- *'i
liam M. Colwell and Margaret Col
well, his wife, to H. S. Ballou & Com
pany, dated September 9th, 1886, ac
knowledged September 17th, 1886, be
fore D. L. Darr, a notary public in and
for Holt County, Nebraska, and rec
orded in the office of the County
Clerk of Holt County, Nebraska, on
the 17th day of September, 1886, in
Book 13 of real estate mortgages at
page 615. And plaintiff avers that
all right of action, on said mortgage J
has been barred for many years last J
past by the statute of limitations and 1
plaintiff further avers that said
mortgage was fully paid to H. S.
Ballou & Company and it is not any
lien upon the premises covered by
said mortgage.
That the Ballou State Banking
Company claims some interest in and
lien upon the East Half of the North

right of action on said mortgage has

the indebtedness secured by said
mortgage and said mortgage has
been fully paid and said mortgage is
no lien whatever upon said premises
covered by said mortgage.
That H. S. Ballou & Company as
signed said mortgage to the Ballou
State Banking Company on January
2nd, 1889, and the said assignment
of said note and mortgage was filed
for record in the office of the County
Clerk of Holt County, Nebraska, on
December 9th, 1890, and recorded in
Book 65 of real estate mortgages at
Page 154 thereof.
That none of the defendants here
in has any title to, interest in or lien
upon said premises or any part there
of.
You are required to answer said
amended petition on or before the 5th
