that, by virtue of an order of sale is
sued out of the District Court of the
United States for the District of Ne
braska, Norfolk Division, and in pur
suance of the decree of said court ren
dered at the September, 1927, term of
said Court, to-wit: On April 27, 1928,
in an action therein pending number
ed 117—Equity, wherein The Penn
Mutual Life Insurance Company, is
plaintiff, and Charles F. McKenna, and
others, are defendants, whereby the
mortgages involved in said action on
the property hereinafter described
were foreclosed, I, B. H. Dunham, as
Special Master of said court, by vir
tue of the authority in me vested as
such Master under the decree and or
der of sale issued to me as such Mas
ter, will on the 8th day of March, 1929,
at 8:45 o’clock, in the forenoon, at the
entrance to the county court house in
O’Neill, the county seat of Holt
County, Nebraska, at the usual place
where sheriff’s sales of land are made
in said county, sell at public auction to
the highest bidder for cash, the prop
erty on which said mortgages were
foreclosed, which said property is sit
uate in the County of Holt and State
of Nebraska, and known and described
as follows, to-wit:
The Southeast Quarter (SE Y*) and
the South Half of the Northeast
Quarter (S%NE*A) of Section num
bered Twenty-four (24), Township
numbered Twenty-nine (29), North,
Range numbered Twelve (12), West
of the 6th P. M., containing 240
acres, more or less, according to
Government Survey.
To satisfy the amounts set forth in
^aid decree as due the parties to said
action, with interest thereon, as fol
lows, to-wit:
(1) The plaintiff in the sum of $12,
204.37 with interest thereon at 10 per
cent per annum from April 27, 1928,
which amount is decreed to be a first
lien on said mortgaged premises.
(2) The counterclaimant, Frank H.
Binder, in the sum of $935.58, with in
terest thereon at the rate of 10 per
cent per annum from April 27, 1928,
upon his first cause of action, which
amount is decreed to be a second lien
on said mortgaged premises.
(3) The counterclaimant, Frank H.
Binder, in the sum of $472.90 with in
terest thereon at the rate of 10 per
cent per annum from April 27, 1928,
upon his second cause of action, which
amount is decreed to be a third lien
on said mortgaged premises.
And to satisfy the sum of $76.25,
costs shown on said order of sale, and
the accruing costs and expenses of
said sale; the proceeds of sale to be
applied, on confirmation of said sale,
as follows, to-wit: (1) To the un
paid costs of said suit that have ac
crued and may accrue; (2) to payment
to plaintiff of the sum found to be due
it, with interest thereon, as in said de
cree provided, and its costs expended;
(3) to payment to counterclaimant.
Frank II. Binder of the sum found to
be due him, with interest thereon, as
in said decree provided, upon his first
cause of action, and his costs expend
ed; (4) to payment to counterclaim
ant, Frank H. Binder of the sum found
to be due him, with interest thereon,
as in said decree provided, upon his
second cause of action, and his cost*
expended, and (5) the surplus, if any,
to be paid to such of the defendants as
may be found at that time to be en
titled thereto.
All as is provided by said order of
sale and decree.
Said sale will be held open for one
hour at the time and place aforesaid.
