petitioner, filed his petition in the
County Court of Holt county, Nebras
ka, in which he alleges that James
Dixon, deceased, died intestate in Holt
county, Nebraska, on the 16th day
of Mav. 1897. while a bona fide resi
dent and inhabitant of said County
and state; that at the time of his
death he was seized in fee simple of
the following described real estate
in Holt county, Nebraska, to-wti: The
southwest quarter of section twenty
seven (27), township thirty (30),
range twelve (12), West of the Sixth
Principal Meridian. That the said
James Dixon left surviving as his
sole and only heirs at law and sole
and only persons interested in his said
estate the following named persons
to-wit: Anthony Dixon, his son; Mary
McDermott, his daughter; Nellie
Murphy, his daughter; Bridget Gal
lagher, his daughter; Agnes Heeb,
his daughter; Kate Johnson, his
daughter; Maggie Mulligan, his
daughter, and William Dixon, his son.
Petitioner further alleges that said
deceased left surviving him Bridget
Dixon, his widow, but said Bridget
Dixon departed this life on the 3rd
day of October, 1899, that said Brid

in said real estate and whatever in
terest she had therein was termi
nated by her death.

To All persons interested in said es
tate both heirs and creditors.
You are hereby notified that on the
28th day of April, A. D. 1920, Fred
Martens petitioner filed his petition
in the Probate Court of Holt County,
Nebraska, in which he alleges that the
said Joseph Joszkowiak departed this
life in Washington County, Nebraska,
intestate on or about February, 1893,
a bona fide resident and inhabitant of
said County and State. That on the
1st day of March, 1893, Gustav Sum
miek and Mary Summick his wife, for
a valuable consideration made, exe
cuted and deliverd a warranty deed
and thereby conveyed the following
des '.bed real estate to the Heirs at
law of jseph Joszkowiak deceased,to
wit: South half of. the southwest
quarter of section thirteen in town
ship twenty-eight north of range four
teen west of the 6th P. M. in Holt
County, Nebraska, and that said deed
was duly filed for record in the office
of the County Clerk of said County
on March 29, 1895, and recorded in
Book 43 of deedss at page 130.
Petitioner further alleges that more
than two years have elapsed since the
date of the death of the said Joseph
loszkowiak and that there are no debts
against said estate unpaid, and that
any debts should there be any are
barred by etatute; and that said real
estate above described is free and clear
of all and any lien thereof.
That there has been no administrator
appointed in the State of Nebraska,
of said estate and no Probate Court
within the State of Nebraska, has ac
quire jurisdiction over said estate.
Petitioner therefore prays for an
order dispensing of the appointment of
an administator, and for a decree es
tablishing who were the legal heirs at
law of the said Joseph Joszkowiak de
ceased on the 1st day of March, 1895,
and their relationship and the law of
decent thereof.
