Kelly left him surviving as his sole
and only heir at law and the sole and
only person interested in his said
estate John D. Kelly his son.
Petitioner further alleges that more
than two years have elapsed since the
date of the death of the said Jeremiah
J. Kelly; that there are no claims,
debts or expenses of any kind or
nature outstanding and unpaid against
his said estate; that said described
real estate is wholly free and clear of
all liens, debts, charges or claims of
any kind or nature, and that no ad
ministrator has been appointed in the
State of Nebraska, and no application
has been made in the State of Ne
braska for the appointment of an ad
ministrator by his heirs or by any
person claiming to be a creditor of
his said estate, and no Probate Court
in the State of Nebraska has acquired
jurisdiction of his said estate.
Petitioner prays for a decree de
termining the time of the death of
said deceased, the heirs at law of said
deceased, the degree of kinship and
right of descent of said described
real estate, and prays that said
named heirs at law' may be
adjudged and decreed by the
Court to be the sole, surviving heirs
at law of said named Jeremiah J.
Kelly, deceased.
You are further notified that a
hearing upon said petition will be had
in the Cunty Court room in the City
of O’Neill, Nebraska, on the 19th day
of December, A. D. 1919, at the hour
of 10 o’clock A. M. when and where
you will show cause if any there be
why the prayer of said petition should
not be granted.
