that James M. Thompson died inte
state at his residence in Holt County
Nebraska, on the 22nd day of May
1909, a bona fide resident and inhabi
tant of the County of Holt; that h<
died possessed in fee simple of the fol
lowing described real estate situatec
in the County of Holt and State of Ne
braska, to-wit: The northeast quartei
of section thirteen (13), townshij
twenty-nine (29), north, range twelve
(12), west of the 6th P. M. That the
said James M. Thompson left him sur
viving as his sole and only heirs at
law, and the sole and only persons in
terested in said estate the following
named persons, to-wit: Alice R
Thompson his widow, Cecil G. Thomp
son and Esther M. Thompson his
minor children.
The petitioner further alleges that
more than two years have elapsed
since the date of the death of the said
James M. Thompson; that there are nc
claims, debts or expenses of any kind
or nature outstanding and unpaid
against his said estate; that said de
scribed real estate is wholly free and
clear of all liens, debts, charges oi
claims of any kind or nature; that nc
administrator has been appointed ir
the State of Nebraska, and no applica
tion has been made in the State of Ne
braska for the appointment of an ad
ministrator by his heirs or by anj
person claiming to be a creditor of his
said estate, and no Probate Court ir
the State of Nebraska has acquired
jurisdiction of his said estate. Peti
tioner prays for a decree determining
the time of the death of the said de
ceased, the heirs at law of said de
ceased, the degree of kinship and righl
of descent of said described rea!
estate, and prays that said named
heirs at law may be adjudged and de
creed by the Court to be the sole, sur
