enbaugh filed her petition in the above
named Court alleging that said Ben
jamine Wells died intestate in the
County of Appanoose in the State of
Iowa, on the 26th day of April, 1912;
that at the time of his death he was
the owner in fee simple of the South
west Quarter of Section Three, (3),
Township Twenty-eight (28), North,
Range Thirteen (13), West of the 6th
P. M. in Holt County, Nebraska; that
petitioner is now the owner by right
of inheritance of an interest in said
land, the prayer of said petition being
as follows: “That the Court may de
termine the time of the death of Ben
jamine Wells, who were his heirs and
the degree of kinship and the right of
descent of the real properly belonging
to said Deceased.”
