Each and all of the above named
defendants will take notice that on
the 16th day of January, 1919, Daniel
A. Doyle, plaintiff, filed his petition
in the District Court of Holt County,
Nebraska, against the above named
defendants, the object and prayer of
which are for a decree quieting and
confirming in said plaintiff the title
to the following described real* estate,
to-wit: The Northeast quarter of
Section Twenty-six (26) except the
right of way of the Chicago & North
western Railwa^ Company, formerly
the Fremont, Elkhom & Missouri Val
ley Railway; the Southwest quarter
of the Southeast quarter and that
part of the North half of the Southeast
quarter lying south of the south line
of the right of way of the Chicago &
Northwestern Railway Company, for
merly the Fremont, Elkhorr & Mis
souri Valley Railway Company; the
South half of the Northwest quarter
and the East half of the Southwest
quarter excepting from said last de
scription the following named tracts
of land, to-wit: Lots One (1), Two
(2), Three (3), Four (4), and Five
(5), in Block Two (2), being all of
Block Two (2), in O’Sullivan’s Ad
dition to the City of O’Neill as per the
recorded plat thereof and known as
the Parker five (5) acres, and that
tract commencing at a point twenty
two and six tenths (22.6) chains north
and thirty-three (33) feet west of the
cjuarter section corner on the south
line of Section Twenty-five (25) and
running thence west ten and five
tenths (10.5) chains and thence north
six and sixty-seven hundredths (6.67)
chains to the south line of the right of
way of the Chicago & Northwestern
Railway, formerly the Fremont, Elk
horn & Missouri Valley Railway,
thence in a southeasterly course along
the south side of said right of way
ten and seven tenths (10.7) chains and
thence south five and three hundredths
(5.03) chains to the place of begin
ning, containing six acres (6), more
or less, and known as the Julia A.
Walmer tract; the North half of the
Northwest quarter; and a tract be
ginning at the southwest comer of
Section Twenty-five (25), in Township
Twenty-nine (29) North, of Range
Twelve (12), West of the 6th P. M.,
thence east along the said section line
a distance of eighty (80) rods to the
quarter corner, thence north two
hundred (200) feet, thence west eighty
(80) rods to a point on the section
line two hundred (200) feet north of
the southwest corner of said Section
Twenty-five (25), thence south two
hundred (200) feet to the place of be
ginning, containing six (6) acres,
more or less; all of said descriptions
except the first above given being in
Section Twenty-five (25) and all of
said land being in Township Twenty
nine (29). Range Twelve (12), West
of the Sixth Principal Meridian in
Holt County, Nebraska, as against
you and each of you; and cancelling
and discharging of record a certain
mortgage given by Daniel P. O’Sulli
van and Mary E. O’Sullivan to H. S.
Ballou and Co., recorded in Book 36,
at page 369 of the mortgage records
of Holt County; and a certain assign
ment of mortgage given by the Union
Trust Company to Helen E. Williams,
recorded in Book 111 at page 548 of
the mortgage records of Holt County,
Nebraska; and barring and enjoining
you and each of you from asserting
or claiming any right, title, equity,
estate or interest therein.
You are reouired to answer said
petition on or before the 24th day of
February, 1919.

Daniel A. Doyle filed his petition in
the Probate Court of Holt County, Ne
braska, in which he alleges that John
Kearney died intestate at his residence
in Holt Conuty, Nebraska, prior to
the 23rd day of January, 1889; that
he died seized in fee simple of the
North half of the Northwest quarter
of Section Twenty-five (25), Town
ship Twenty-nine (29), Range Twelve
(12), West of the Sixth Principal Me
ridian in Holt County, Nebraska. And
the petitioner alleges that the said
John Kearney left him surviving as
his sole and only heirs at law, the fol
lowing named persons who are re
lated to him in the manner hereinafter
indicated, to-wit: Margaret Kearney,
his widow, Luke Kearney, his son,
Thomas Kearney, his son, John Kear
ney, Jr., his son, and Mary Griffith,
formerly Mary Kearney, his daughter.
The petitioner alleges that by good
and sufficient deeds of conveyance he
hns acquired all the right, title and in
terest of said named heirs at law;
that he is now the owner of said de
scribed real estate, and alleges that
more than two years have elapsed
since the date of the death of said de
ceased; that said real estate is free
and clear of all liens, claims and
charges of every kind and descrip
tion, and prays for a decree deter
mining the time of the death of the
said deceased, and the heirs at law of
said deceased and degree of kinship
and right of descent of the above de
scribed real estate.
You are further notified that the
hearing upon said petition will be had
in the county court room in O’Neill,
Nebraska, on Saturday, the 22nd day
of February, A. D., 1919, at the hour
of ten o’clock A. M., when and where
you will show cause, if any there be,
why the prayer of said petition should
not be granted.
