Scott; that proceedings were commenced in the Probate Court for the probate of the estate of Barrett Scott, deceased; that an administrator was appointed; that said administrator filed his final account but no order discharging him was ever entered in said cause, and no decree of distribution or finding of the Court was entered with reference to said homestead; that said administra tor is now deceased, and that because of the condition of the record it does not appear that the said described premises was the homestead of said deceased, and no decree of distribu tion has been entered therein, and that because of said fact the title of peti tioner is clouded thereby and de preciated, and petitioner prays for a decree determining the time of the death of the said deceased, the heirs at law of said deceased, and the de gree of kinship and right of descent of the above described real estate, and prays for a decree finding that said described real estate constituted the homestead of the said deceased and of the said family, and that the same was wholly exempt of all claims, debts, charges and costs of every kind and nature against the estate of the said Barrett Scott and finding that the same was in value at the time of the death of said deceased less than $2,000.00.
