as the last will and testament of
James H. Early, deceased, an in
strument in writing, purporting to
be the last will and testament of
James H. Early, deceased, and which
is now in the possession of said
County Court, and, whereas, on the
11th day of December, 1918, said
County Court made an order providing
for the service of notice by publica
tion to all persons concerned and in
terested in said estate, in which it is
ordered by said court that all persons

28, 18B1, and recorded April 28, 1891,
in book 55 of mortgages at page 418
of the records of Holt County, Ne
braska, conveying the following real
estate in Holt County, Nebraska, to
wit: Commencing at southwest cor
ner of Block “D,”in McCaflferty’s 2nd
Addition to O’Neill, Nebraska; thence
running east 90 feet; thence north 170
feet; thence west 90 feet; thence south
170 feet to place of beginning, de
creed to be fully paid and satisfied,
and to be barred by the statute of
limitations of the state of Nebraska
and no longer a lien on said premises;
and to have you decreed to have no
lien upon or interest in said premises;
and to forever enjoin you from as
serting any lien upon or interest in
said premises.

1918, this cause came on to be heard
upon the application of Fred H. Swing
ley as administrator of the estate of
Fritz Trumpeter, deceased, for a hear
ing upon his final account herein and
for the closing up of said estate and
the discharge of him as such ad
ministrator and that Helen Gerlitz as
heir of Fritz Trumpeter, deceased, had
paid the sum of $6031,98, to pay all of
the debts of said estate and thereby
close up said administration.
It is, therefore, hereby ordered that
the final hearing on said account and
for the closing up of said estate and
the discharge of said administrator,

hearing in the County Court of Holt
County, Nebraska, at O’Neill, Ne
braska, at the hour of ten o’clock A.
M. on the 17th day of January, 1919.
And this matter coming on further
to be heard upon a petition filed in
said Court in this proceeding by Helen
Gerlitz alleging that she is a niece
and sole heir of Fritz Trumpeter, de
ceaesd, and as such heir that she is the
owner in fee simple of the following
described real estate situated in the
County of Holt and State of Ne
braska, to-wit: The West Half of
Section Thirty-one, in Townhip Thirty
North, of Range Twelve West of the
Sixth Principal Meridian, and also the
owner of all the personal property of
said Fritz Trumpeter now in the hands
of said administrator. Said Helen
Gerlitz prays for a deccree of the
Court adjudging and decreeing and
finding that she is a niece and the sole
heir of Fritz Trumpeter, deceased, and
as such heir, the owner of all of
said premises and said personal
property, and she prays the Court to
make a decree herein adjudging and
decreeing and assigning to her by
decree the said premises and personal
property aforesaid and all the estate
of Fritz Trumpeter, deceased, and
praying the Court to enter its decree
adjudgmg her to be the owner in fee
simple of said premises and the owner
of said personal property as such sole
heir of Fritz Trumpeter, deceased.

sons occupying the premises shall im
mediately after discovery of the dis
ease be under quarantine even if not
reported as herein provided.
(b). Whenever the disease of in
fluenza or other communicable disease
exists and the same has not been re
ported as above provided, or there is
reason to believe it has not been re
ported, it shall be the duty of any
and every nerson having knowledge
of the same to promptly report to the
County Board of Health.
QUARANTINE BY PHYSICIAN.
It shall be the duty of physician in
all cases of influenza or other com
municable diseases immediately upon
discovery cf the disease' to place the
premises, and all persons occupying
the same who have not had the dis
ease and fully recovered therefrom,
under strict quarantine. He shall
before leaving the premises sign and
deliver to the head of the family, and,
in the event of his absence, to some
member of the family, notice of quar
antine, and shall also before leaving
the premises place or cause to be
placed upon the most conspicuous
place on the premises a card, not less
than 11 inches. square, having there
on in large letters the word “Quar
antine,” under this the name of the
disease and under this “No one shall
be permitted to enter or leave these
premises.”
