All persons interested in the estate
of Patrick Fahy, Deceased, will take
notice that on June 13, 1918, Lewis
Chapman, filed his petition in
County Court of Holt county, Ne
braska, alleging that Patrick Fahy
died intestate in the county of Dane,
and state of Wisconsin, on September
4, 1903, seized in fee simple
of the following described real estate
situated in the county of Holt and
state of Nebraska, towit: Lots
Four (4), Five (5), Six (6), Seven
(7), and Eight (8), in Block K, in
fahy s Park addition to O’Neill, and
leaving surviving him, as his sole and
only heir, his son Paul Fahy. That
f.petitioner is the owner of said real
V-' estate by a direct and also a mesne
conveyance from said Paul Fahy.
That the prayer of said petition is:

Patrick Fahy; that he died intestate

CHATTEL MORTGAGE SALE.
Notice is hereby given that under
and by virtue of a certain chattel
mortgage, and the powers therein
contained, and which mortgage was
executed on the 16th day of April,
1917, by G. W. Goodwin and O. K.
Wright, and which mortgage and the
debt by it secured have been assigned
to Abe Slimmer and L. J. Thomas;
and
Whereas, a copy of said mortgage
was duly filed in the office of the
county clerk of Wheeler County, Ne
braska, on the 20th day of April,
1917, where said cattle were then
situated and said Goodwin resided;
and
Whereas, a copy of said mortgage
was duly filed in the office of the
county clerk of Holt County, Ne
braska, where said cattle are now
situated, on the 19th day of June,
1918; and
Whereas, default has been made
in the payments of the debt secured
by said mortgage, and no proceedings
at law have been had to recover the
debt secured by said mortgage; and
Whereas, there is now due on said
mortgage and the debt by it secured
the sum of Eight Thousand Five
Hundred Thirty-one and 46-100 ($8,
631.45) Dollars.
Now, Therefore, we the under
signed, Abe Slimmer and L. J.
Thomas, as the owners of said mort
gage and the debt by it secured, will
sell at public auction to the highest
and best bidder for cash, on Saturday,
the 13th day of July, 1918, at the
hour of one o’clock, p. m., at the
ranch of Peter Nelson about seven
miles south of Chambers, all in Holt
County, Nebraska, the following de
scribed property which were in
cluded in and conveyed by said mort
gage:

of Holt County, Nebraska, a duly veri
fied petition, the object and purpose
of said petition being to have the
court dispense with regular adminis
tration in the estate of Edward B.
Bishop, deceased, and aiso in the
estate of Barton Bishop, deceased, and
to have the court find, adjudge and
decree the names, ages and residences
of the heirs at law of Edward B.
Bishop, deceased, and Barton Bishop,
deceased, and that said Edward B.
Bishop left an estate of inheritence
consisting of real property described
as follows: The Northeast Quarter
of Section Eight (8), in Township
Twenty-nine (29), North of Range
Nine (9), West of the Sixth P. M. in
Holt County, Nebraska, and also the
Northwest Quarter of Section Nine
(9), in Township Thirty-one (31),
Range Twenty-one (21), West of the
Sixth P. M. in Brown County, Ne
braska, and that Barton Bishop, now
deceased, left an apparent equitable
interest in the above described real
estate; that said real property above
described and all interest therein is
wholly exempt from execution, at
tachment or other mesne process and
not liable for the payment of the
debts of either Edward B. Bishop or
Barton Bishop, now deceased, and to
have the court make an order that the
regular administration of the estate
of Edward B. Bishop, deceased, and
Barton Bishop, deceased, be dispensed
with, and that the court make and
enter its findings of fact upon the al
legations of the petition, and to have
the court make and enter a final de»
cree naming the sole heirs at law of
the raid Edward B. Bishop, deceased,
and Barton Bishop, deceased, under
the laws of this state as they existed
at the time of the death of each of
said deceased persons, together with
their ages and places of residence.
You are required to appear at 10
o’clock A. M., July 22nd, 1918, and
show cause, if any there be, why the

the section line for a distance of four
miles to the northeast corner of sec
tion 31, township 28, range 12, has
been traveled for the last ten years
or more, therefore I move you that
we declare the foregoing road a pub
lic road by usage and dedication, and
the County Surveyor is instructed to
record and plat the road as herein des
cribed in the road records of Holt
county.

feet; said extended tract width to be
to the north along said road, and the
County Clerk is instructed to issue
a warrant in the sum of $50.00 to
John Dougherty as payment in full
for all damages due him by reason
of the establishment of said road.
