during his lifetime and Susan Ann

east half of the northwest quarter,
(Ei NWi), of section thirty-live (35),
in township twenty-six (26), north of
range fifteen (15), west of the Sixth
(6), P. M. in Ilolty county, Nebraska,
for the sum of $500, together with in
tertest, wherein this plaintiff was
plaintiff and said defendants were de
fendants for the reason the dismissal
of said petition was obtained by Wil
liam It. Butler who falsely and fraud
ulently represented to the court that
he was the duly authorized attorney
for all the defendants, when in fact he
had not been employed by them nor
any of them.
You and each of you are further
uocitied that you are required to
answer said petition on or before Mon
day, June 7th, 1909.

that Ishmael Pugh lias commenced an
action in the district court of Holt
county, Nebraska, against you and
eacii of you the object and prayer of
said action and petition being to ob
tain a partition and judgment con
firming the shares of the plaintiff and
the defendants Sarah Pugh and Ann
Davies in and to the following de
scribed real estate situated in Holt
county, Nebraska, to-wit: the south
west quarter of section fifteen (15),
township twenty-eight (28), north of
range twelve (12), west of the Cth p.
m. Plaihtiff praying in said petition
that if said land cannot be equitably
divided then that the same may be
sold and the proceeds thereof divided
between the plaintiff and Sarali Pugh
and Ann Davies. Plaintiff alleging in
said petition that the above described
real estate was owned by his brother
Samuel Pugh at the time of his death,
May 24,1907, and that the plaintiff
and the defendants Sarah Pugh and
Ann Davies are brother and sisters of
the deceased and the only heirs at law
of the deceased, he having left surviv
ing him no father, mother or widow
or any other persons entitled to share
in said real estate. Plaintiff alleging
that he has an undivided one-tliird
interest in said land and that his sis
ters, Sarah Pugh and Ann Davies
have each a similar estate and interest
in said land and prays that a partition
and distribution of said real estate or
the proceeds thereof be made accord
ing to their respective rights.
Plaintiff further alleges that the
other defendants named in said
petition have no interest in said real
estate but that their claimed interest
casts a cloud on the title to said real
estate and prays that the same may
be set aside by a decree of this court
and they excluded from all interest in
said real estate and that the mortgage
given by Ellen Keys on said land to
the Showalter Mortgage Company
August 1, 1888, and recorded in book
40 of mortgages at page 472 be decreed
to be fully paid and satisfied and bar
red by the statute of limitations and
for such other and further relief as
may be just and equitable. You are
required to answer said petition on or
before the 7th day of June, 1909.

Cafferty, John J. McCafferty her hus
band, Farewell, Ozman, Kirk & Comp
any, International Harvester comp
pany, T. G. Northwall company, the
Morrison Manufacturing company,
the National Burial Device company,
and the Beebe & Runyan Furniture
company and the Deering Harvester
company as defendants, for the sum of
four thousand five hundred and seven
ty-three dollars with interest from
date of decree at 10 per cent per
annum found due plaintiff as a first
lien, one hundred one and 19-100 dol
lars with interest at seven per cent
found due National Burial Device
company as a second lien and five
hundred twenty-nine dollars with in
terest at the rate of 10 per cent due
T. G. Northwall company as a third
lien and sixty-eight and 15-100 dollars
costs of suit, and the costs taxed at
$68.15 and accruing costs, I have
