day of January, 1908, and duly hied in
the office of the county clerk of Holt
county, Nebraska, on the 25th day of
January 1908, and executed by Charles
Spangler to Mrs. W. Spangler, and
afterwards on the 5th day of February,
1908, sold and assigned to D. L llo
docker to secure the payment of the
sum of one hundred sixty seven dol
lars and upon which there is now due
the sum of one hundred eighty three
dollars and 23-100 dollars, default hav
ing been made in the payment of said
sum, and no suit or other proceedings
at law having been instituted to re
cover said debt or any part thereof^
therefore 1 will sell the property

that John E. Vance as piaiutiff
has commenced an action in the dis

being to obtain a decree quieting and
confirming in him the title in and to
the following described real estate
situated in Holt county, Nebraska, to
wit: the southwest quarter of section
nine (9), township twenty-nine (29),
north of range ten (10) west of the
6th P. M., plaintiff alleging in said
petition that he is the aosolute owner
of said real estate and in the posses
sion thereof that the defendants have
no claim, right, title, lien or interest
in or to said real estate but that they
assert some claim or interest therein
and that their claimed interest casts
a cloud on his title to said real estate
which ought to be removed by a decree
of this court and the defendants ex
cluded from claiming any interest in
said land and prays that he be decreed
to be the absolute owner of said real
estate and the title thereto quieted
and confirmed in him and the defend
ants and each an all of them be re
strained and enjoined from asserting
any interest in said real estate and
from in any manner encumbering the
title thereto and that the apparent
cloud cast on his title to said real
estate by reason of the claimed inter
est of the defendants be removed and
that the defendants and each and all
of them be forever restrained and en
joined faom asserting any interest in
said real estate and for other equi
able relief. You are required to
