ber, 1908, the plaintiff herein, Edmond
H. Benedict, tiled his petition in the
office of the clerk of the district of
Holt county, Nebraska, against Ed
ward L. Purdy, Mary Purdy, his wife,
William F.Puidy, Laura Purdy, his
wife, Alice M. Benson, formerly Alice
M. Purdy, Stephen H. Benson, her
husband, Carry E. White, formerly
Carry E. Purdy, Edward E. White,
her husband, Annie Coleburn, Nellie
Coleburn, a minor, Clarence Coleburn,
a minor, Annie Coleburn, guardian of
said minors, Susan Purdy, widow
and heirs-at-law of Pitt L. Purdy,
deceased, William D. Matthews, Mal
com Baird, Mrs. Malcom Baird, his
wife, lirst and full name unknown,
Silas W. Morton, and Mrs. Silas W.
Morton, his wife, lirst and full name
unknown, defendants, the object and
prayer of which is to have a judgment
order of the district court of Holt
county, Nebraska, made on the 27th
day of April, .905, found of record in
said court, in Journal 22, at page 565,
in an action then pending in said
court for the foreclosure of a certain
mortgage executed by Pitt L. Purdy
during his lifetime and Susan Anna
Purdy, his wife, upon north half Of
the northeast quarter (NINE*), and
east half of the northwest quarter,
(Ei NWi), of section thirty-five (35),
in township twenty-six (26), north of
range fifteen (15), west of the Sixth
(6), P. M. in Holty county, Nebraska,
for the sum of $500, together with in
tertest, wherein this plaintiff was
plaintiff and said defendants were de
fendants for the reason the dismissal
of said petition was obtained by Wil
liam R. Butler who falsely and fraud
ulently represented to the court that
he was the duly authorized attorney
for all the defendants, when in fact he
had not been employed by them nor
any of them.
You and each of you are further
notified that you are required to
answer said petition on or before Mon
day, January llth, 1909.
