object and prayer of which are to
obtain a divorce from you on the
grounds that you have been guilty of
extreme cruelty of and toward her
without any cause, excuse, or provoca
tion on her part in this, that on or
about the 19th day of May, 1907, and
at other times that you cruelly struck,
beat, and bruised her; that your
treatment of the plaintiff lias been
harsh and cruel and unbecoming a
husband, and that you on many and
different occasions have abused tier by
the use of threatening language and
threatening physical violence to her.
and that by reason of your conduct
that she was compelled to leave you.
Plaintiff further prays that she be re
stored to her former name.

A sufficient contest affidavit having
been tiled in this office by Lyman H.
Spangler, contestant, against home
stead entry No. 20642, made January
31st, 1906, for the Si SEi, NWi SWi
and Si SWi Sec. 17, and Ni SEi and
SEi SEi sec. 18, and NEi NEi Sec. 19
and Ni NWi section 20, township 27,
N. range 16, W., by William 11. Lowe,
conlestee, iu which it is alleged that
said William H. Lowe died on or
about November 15,1907, at Nebraska
City, Otoe county, Nebraska, in tes
tate, leaving no last will and testa
ment and leaving as his sole heirs-at
law, his son, James L. Lowe, age 60
years, residing at Ashland, Oregon;
his daughter, Mary Winton, residing
at Nebraska City, Nebraska, aged
about 45 years; his son, Lee Lowe, re
siding at San Francisco, California,
aged about 40 years; and Alice Lowe,
residing at Nebraska City, Nebraska,
aged about 36 years, his daughter.
That since the death of said entry
man, none of said heirs have ever
established a residence on said tract
of land, and have wholly abandoned
the same.
Tim none or saio neirs nave usea,
occupied, cultivated, or improved said
tract in any way, or procured the
same to be done by any other person,
and said heirs have wholly abandoned
said tract for more than six moiths
last past, and that said alleged
absence from the said land was not
due to the employment of any of said
heirs In the army, navy, or marine
corps of the United States, as a priv
ate soldier, officer, seaman, or marine,
during the war with Spain, or during
any other war in which the United
States may be engaged. •
Said parties are hereby notilied to
appear, respond and offer evidence
touching said allegation at 10 o’clock
a. m., on October 19,1908, before the
Register and Receiver, at the United
States Land Office, in O’Neill, Ne
braska.
The said contestant having in a
proper affidavit, Hied September 14,
1908, set forth facts which show that
after due diligence personal service of
this notice can not be made upon the
above named contestees, James L.
Lowe, and Lee Lowe, it is hereby
ordered and directed that such notice
be given the said James L. Lowe, and

The following proposed amendment to
the constitution of the State of Ne
braska, as hereinafter set foith In full,
Is submlttsd to the elector* of the State
of Nebraska, to he voted upon at tht
general election to be held Tuesday, No
vember 3rd, A. S. 1908:
A JOINT RESOLUTION to amend Sec
tions two (2), four (4), five (5), six (b)
and thirteen (13) of Article six t6) of
the Constitution of the State of Ne
braska, relating to Judicial Powers.
Be It Resolved by the Legislature of the
State of Nebraska:
Section 1. Amendment proposed. That
Section two (2) of Article six (6) of the
Constitution of the State of Nebraska
be amended to read as follows:
Section 2. (Supreme court;» Judges;
jurisdiction.) The Supreme Court snail
consist of seven (7) Judges, and a ma
jority of all elected and Qualified Judges
shall be necessary to constitute a
quorum or pronounce a decision. The
Supreme Court shall have jurisdiction in
all cases relating to the revenue, civil
cases in which the state is a party,
mandamus, quo warranto, habeas corpus,
and such appellate Jurisdiction as may
be provided by law.
Section 2. (Amendment proposed.) That
Section four (4) of Article six '6) of the
Constitution of the State of Nebraska be
amended to read as follows:
Section 4. (Supreme court. Judges,
election, term, residence.) The Judges of
the Supreme Court shall be elected by
the electors of the state at large; and
their terms of office, except as hereinafter
provided, shall be six years. And said
Supreme Court Judges shall during their
term of office reside at the place whebe
the court is holden.
Section 3. (Amendment proposed.) That

Constitution of the State of Nebraska be
amended to read as follows:
Section 5. (Supreme court, judges,
•lection, term; chief justice.) That at
the general election to be held in the
state of Nebraska in the year 1909, a 9
each six years thereafter, there shall i.
elected three (3) judges of the Supreme
Court, who shall hold their office for the
period of six years; that at the general
election to be held in the state of Ne
braska In the year 1911, and each six
years thereafter, there shall be elected
three (3) judges of the Supreme Court,
who shall hold their office for the period
of six years; and at the gene-sl el-etlOn
i to be held in the state of Nebraska in
the year 1913, and each six year., there
after, there shall be elected a Chief Jus
tice of the Supreme Court, who shall
hold his office for the period of six
years. Provided that the member of the
Supreme Court whose term of office ex
pires in January, 1914, shall he Chief
Justice of the Supreme Court during that
time until the expiration of his term of
office. And, provided further, that upon
the adoption of these nmeodm»nt-- bv too,
electors of the State, the Governor shall,
immediately upon issuing his proclama
tion declaring said amendments adopted,
appoint four (4) judges of the Supreme
Court, two (2) of whom shall be ap
pointed to hold said office until their
successors shall be elected at the general
election in 1909, and have qualified; and
the other two (2) shall hold their office
until their successors shall be elected at
the general election held in 1911, and
have qualified. _
Section 4. (Amendment proposed.) That
Section six (6) of Article six '81 of the
Constitution of the State of Nebraska, be
amended to read as follows:
Section 8. (Chief Justice.) The Chief
Justice shall serve as such during all the
term for which he was elected. He shall
preside at all terms of the Supreme
Court, and in his absence the judges
present shall select one of their number
to preside temporarily. _
Section 6. (Amendment proposed.) That
Section thirteen (13) of Article six (6) of
the Constitution of Nebraska be amended
to read as follows:
Section 13. (Judges, salaries.) That
Judges of the Supreme Court shall each
receive a salary of $4,500, and the Judges
of the District Court shall each receive
a salary of $3,000 per annum, payable
quarterly.
