M. in Holt county, Nebraska, and to en join the defendants from asserting or claiming any title or interest therein. Plaintiff alleges that on the 4th day of January, 1900, the said The London and Yankton Development Co , by a resolution of its board of directors, in structed its secretary, Harry Eller to make, execute and deliver to Schaller and Skidmore, a quit claim deed to the above described premises. That in pursuance to said resolutions and instructions of the said The London and Yankton Development Co., the said Harry Eller, secretary ot said company, duly made and executed under the corporate seal of said com pany a quit claim deed to said prem ises and that said deed was duly re corded on February 13,1900, in book 55 of deeds page 146 of the records of Holt county, Nebraska. That the said resolutions passed by the said The London and Yankton Develop ment Company instructing its secre tary, Harry Eller, to make a deed of said premises to Schaller and Skid more, were not attached to said deed and were not recorded. That the said The London and Yankton Develop ment Company was a foreign corpor ation and is now dissolved and its records including the record of the resolutions and instructions to Harry Eller, secretary, have been lost or destroyed. That the failure of the defendant to attach its lesolutions and instructions above named, to said deed and having the same recorded, casts a cloud on plaintiff’s title which tends to depreciate the value thereof. One Man Who Lived That He Might Simply Eat and Drink. In a little yellowed English maga zine, dated April, 1804, I came across the following amusing scrap: if the Duke of Q. does not extend hi3 life to a still longer period, It will not be for want of culinary comforts and those other succulent arts by which longevity Is best promoted. The candidate admitted that he had once been a member of a jury which tried a negro for murder.
