In the matter of the estate of Henry Herb
age. deceased.
On this 14th day of October, A. D. 1905,
Daniel Herbage and John Herbage filed their
petition in this court and presented an au
thenticated copy of the last will and testa
ment of Henry Herbage deceased, late of the
county of On led a, ana state of New Vork,
the prayer of said petitioners being that a
day be fixed by this court for the purpose of
approving and allowing said last will and
testament, and causing the same to be filed
and recorded In this office, it Is therefore
hereby ordered, that Saturday, the 4th day
of November, 1905, at 10 o’clock a. m. be fixed
lor hearing said petition,when all persons In
terested in said matter may appear and show
cause why the prayer of said petition should
not be granted; and that notice of the pen
dency of said petition and the hearing there
of, be given to all persons interested in said

Henrietta K Riggs, R. H. Mills, Ellen Little
August Truzeniskie, Mary A. Harding and
Maggie Kirwin, are plaintiff’s, and against
W. D. Mathews as defendant, for the sum of
one hundred dollars, and the costs taxed at
$1.25and accruing costs, I have levied upon
the following real estate taken as the proper
ty of the said defendant to satisfy said order

A sufficient contest affidavit having been
filed in this office by William D. McNally,
contestant, against homestead, entry No.
18,325, made October 1st, 1903, for the SE hi SE
/•4, section 18, township 28 N, range 12 W, by
Frank Canfield, contestee, in which it is al
leged that said Frank Canfield has never es
tablished a residence on said tract of land,
and has wholly abandoned the same for
more than six months last past, and that
said alledged absence from the said land was
not due to his employment In the army,navy
or marine corps of the United States as a pri
vate soldier, officer, seaman or marine dur
ing the war with Spain or during any other
war in which the United States may be en
gaged. Said parties are hereby notified to
appear, respond and offer evidence touching
said allegation at 10 o’clock a. m. on Decem
ber 7, 1905, before the register and receiver at
the United States land office in O’Neill, Neb.

show that after due diligence personal ser
