were read and approved.

Board met pursuant to adjournment

On motion the county clerk was
instructed to assign to V. V. Rosen
krans all the rights, title and
interest of llolt county in the mat
ter of taxes on the swj of the nwi of
section 34, township 32, range 9.

The following petition was read:
To the honorable board of super
visors of Holt, county, Nebraska:
Gentlemen—Your petitioner states
that he is a resident freeholder and
taxpayer of Stuart township in Holt
county. Nebraska, that during the
entire year of 1901 all his cattle num
bering about eighty bead of cows
were kept on section 29, township 31,
north of range 15 west in Holt county;
that none of his cattle during the
year 1901 were kept within the cor
porate limits of the Village of Stuart
or school district number 44 in Holt
County. That all the above described
property was assessed in the Village
of Stuart and in school district num
ber 44 and 1 respectfully pet ition the
honorable board to reduce the rate of
taxes to correspond with the rate on
other property in 1 he locality where
my property is located and kept and
to this end your petitioner ever prays.

Mr. Chairman—I move you that the
assessment of personal property of
Frank Dobney in the Village of Stuart
for (he year 1901 be stricken from the
tax list in tlie Village of Stuart and
that the same property be placed on
the tax list in Stuart township in
school district number 188 for said
year; that being where it should have
been assessed and the clerk be in
structed to make the necessary cor
rection on the tax book.

Tlie following communication from
the county attorney was read:
Gentlemen—My attention has been
called to your report of settlement
with John M. Stewart, ex-sherilf of
Holt county. Not having any otlicial
not ice from you regarding this matter,
the lirst knowledge I received of your
finding, was in the press of the coun
ty. 1 note what you say in regard to
having tlie county attorney “com
mencing action to recover to Holt,
county the amount due from the cx
Sherifl John M. Stewart.” In your
report you state that you have found
that John M. Stewart has collected
and retained $195 of fees charged in
excess of the amount allowed by the
statute of the Slate of Nebraska for
the year 1901; you make further find
ing that tlie same excess charges
were made for the years 1898, 1899
and 1900 and the amount of over
charges due to the county from John
M, Stewart for all of said years is
$436.05. As the prosecuting officer of
this county, I stand willing to prose
cute any public officer who has one
cent that belongs to the County. 1
am ready to acu in this matter, but I
must have something on which lo
oase a proseeut ion. iieture a success
ful prosecution can be maintained it
will be necessary to have the names
of the particular cases and separa.e
items of every charge in each case
both those that are legal and those
that are illegal; also the name of the
person who paid the excessive or
illegal charges. If you will kindly
furnish me this information I will
Investigate and take the necessary
steps to recover to Holt county any
excessive charges that it has paid.

The following petition was read:
To the board of supervisors of Holt
county, Nebraska:
Gentlemen- We, the undersigned
electors residing within five miles of
the proposed now bridge petition that
a public bridge be built on the section j
line running east and west between
sections 12 and 13, in township 33, !
range 14 in Holt county, Nebraska, !
on the Big Sandy creek, where the
old bridge used to be. The bridge to
be 28 foot long and 14 foot wide and
piling to be 1G foot long.
Dated February 27, l!k)2, and signed
by F. Ellis and 37 others.
Mr. Chairman—I move you that
the prayer of the petition lie granted
and that the clerk be instructed to
advertise for bids for the construction
of said bridge according to plans on
tile in the clerk’s office.

The following petition was read:
To the honorable board of supervis
ors of Holt county:
Gentlemen—We, t lie undersigned
petitioners do request your honorable '■
body to build a 30 foot span wagon
bridge across the Red Bird creek at
a point where said creek crosses sec
tion line between section one and
thirty-six, the same being the town
ship line between township thirty
and thirty-one, range eleven west.
The fording near it is now practically
imnassihle and has been for over sixty
days and is so every winter for from
sixty to one hundred days.
