tice of the peace In and for O’Neill, Holt
county, Nebraska, issued an order of attach
ment for the sum of one hundred and fifty
dollars, In an action pending before him In
which A, Oastetter Is plaintiff and L. C.
Stott Is defendant. That property of the
said L. C. Stott, consisting of one sorrel mare
with two white feet, one bay mare, one black
horse, one bay horse and one sorrel mare,
has been levied on and J. Ives, Mr. Turner,
first and full name unknown, and O. A.
McOuteban have been garnished under said
order of attachment. Said cause was con
tinued to the 20th day of July. 1897, at one
o’clook p. m.

Philo Drake and Adeline Drake, defend
ants, will take notice that C. T. Oorham,
plaintiff, on the 28th day of July, 1897, filed a
petition In the district court of Holt county,
Nebraska, against said defendants. Implead
ed with the Oregon Horse and Land Co., the
object and prayer of which Is to foreclose a
mortgage dated March 111, 1888, for*409 and
Interest upon the southeast quarter of the
northeast quarter (8E!4 NB>4), northeast
quarter of the southeast quarter (NEJ4 SEJg)
of section twenty-one (21) and the west half
county, Nebraska, given by Philo Drake and
Adeline Drake to John J. Kochs, trustee, and
assigned to plaintiff, which mortgage was
recorded In book 35 of mortgages on page 595
of the records of Holt county.
Plaintiff prays for a decree that defendants
lay (563.33 with Interest at 10 per cent, from
lept. 30, 1897. and the further sum of (60.20
for taxes paid by plaintiff with Interest from
Sept. 30. 1807, at 10 per cent, and that In
default thereof said premises may be sold to
satisfy the amount found due.

above described tract of .land: You and
each of you are hereby notified that the
petition of the above named plaintiff Is now
on file In the office of the olerk of the district
court of Holt county. Nebraska, claiming
that plaintiff purchased said lands at a regu
lar tax sale, on the 7th day of November.
1892, for the taxes then due, delinquent and
unpaid, and paid therefor the sum of
eighteen and 50-100 dollars. (318.50), and that
under and by virtue of said sale, has paid
subsequent taxes on said land as follows,
to-wit: October 28.1893, the sum of nineteen
and 90-100 dollars, (319.90), and on the 16th day
of May, 1894, the sum of nineteen and 38-100
dollars. (319.88). That subsequent to the date
of said sale and in such time as by statute

caused a notice to be served upon the owner
of said lands and upon allpersons In pos
session thereof requiring them to redeem
said lands from said sale and made proof of
suoh service by affidavit filed with thecounty
treasurer aforesaid; that on the 22nd day of

sale aud payment was Issued and delivered
to plaintiff purporting to convey Bald lands

plaintiff the amount of said lien within suon
time as the court may fix, and upon a failure
