The above named defendants and eaoh of
them will take notice that on the 26th day of
February, 1887, the above named plaintiff
filed his petition In the district court of Holt
couuty. Nebraska, against said defendants,
tbe objeot and prayer being to foreclose a
certain mortgage executed by the defend
ants, Milton McDirmlt and wife to the Union
Trust Company, and by It assigned to Daniel
It. Goodwin, during his life, for a valuable
consideration and now tbe property of his
said estate. Said mortgage being given to
secure the note of the defendant. Milton
McDirmlt, dated November 1,1886, for *700,
and due November 1,1881, with interest at 7
per cent, until maturity, and 10 per cent,
after maturity. Said mortgage being given
on the southeast quarter of section tnree,
township twenty-eight,'range twelve. In Holt
county, Nebraska. Plaintiff alleges that
there Is due on said note and mortgage the
sum of *700 with Interest at 10 per cent, from
Mav 1,1803, and the further sum of 1100 paid
by plaintiff to secure assignments of tax salo
certificates on said land, and alleges that said
amounts are a first lien on said premises, and
prays that said real estate may be sold to
satisfy the amount found due tne plaintiff,
and that the lnteress of each of the defend
ants be decreed to be subject to said mort
’ gage.
And for other equitable relief.
You are required to answer said petition
on or before the 12th day of April, 1887.
