The above named defendants and each of
them will take notice that on tho 28th day of
February, 1807, the above named plaintiff
filed his petition In tho district coutt of Holt
county. Nebraska, against said defendants,
the object and prayer being to foreclose a
certain mortgage executed by the defend
ants, Milton McDIrmlt and wife to the Union
Trust Company, and by It assigned to Dunlel
K. Goodwin, during his life, for a valuable
consideration and now the property of his
said estate. Said mortgage being given to
secure the note of the defendant, Milton
McDIrmlt. dated November 1,1888, for 8700,
and due November 1,1801, with Interest at 7
per cent, until maturity, and 10 percent,
after maturity. Said mortgage being given
on the southeast quarter of section tnree,
township twenty-eight, range twelve. In Holt
oounty, Nebraska. Plaintiff alleges that
there Is due on said noto and mortgage the
sum of (700 with Interest at 10 per cent, from
May 1.1800, and the further sum of (too paid
by plaintiff to secure assignments of tax salo
certificates on said land, and alleges tliut said
amounts are a first lien on said premises, and
prays that said real estate muy be sold to
satisfy the amount found due the plaintiff,
and that the luteress of each of the defend
ants be dooreed to be subject to said mort
