It takes effect in 00 days after tbo adjournment of the legislature Section 1. It shall be unlawful for any person to catch, kill, injuro or de- stroy any fish in any public water in this state in any way what ever except with tho use of hook and line: tho use of seines, nets and othor devices oxcept the hook and line being horeby prohlb ited and made unlawful. Publio waters within tho meaning of this see tion shall ombraco all lakes, ponds, rivers, creeks, bayous and streams ex cept private artificial pond or ponds, subject to tho exclusive dominion of a slnglo ownership. Every violation of any provision of this section shall bo a misdemeanor, and every person, obsoh elation or corporation convicted of an offenso under this section shall pay a flnonot less than twenty-five ($25.00) Dollars and costs of prosecution, or suffer imprisonment in tho county jail not less than ton (10) days, or until Buch fine and costs are paid. It shall bo unlawful for any person to have in bis or her possession any soino, not or other unlawful InBtru ment or dovice for taking or injuring fish with the intent of using tho same n any water In this state, and it is hereby made tho duty of all constables justices of the peace and police judges of this Stato to prosecute all offenseB against this act. Every ssino, net, or other unlawfu device nnder this act found in any water in this stato or in tbo possession of any person intending to use the same in violation of this act may be seized by any person with or without warrun and deposited with a justice of the peace or police judge, who shall cause the owner or person having such seine net or other unlawful device in his possession if known to appear before said court and show cause why such seine, net or unlawful device should not bo destroyed : Buch court shall upon such hoariog or upon default enter judgment and in all cases ot condem nation such seine not or unlawful de vice shall bo destroyed under the direction of said court. In all cases under this act the constable's and jus t Ice's fees shall be tho same as in other cases of misdemeanor. Seo. 2. Provided that nothing in this aot shall be construed to apply to boundary streams of tho state of Nes braska, except bo much of said bound ary streams as shall be within one hun dred feet of the mouths of streams tributary thereto; nor Bball anything in this act apply to persons fishing in such bouudary streams outside of the limit of one hundred feet from tho mouths of said tributaries; nor to seines or nets owned or kept by per sons residing within a distance of nut more than ten (10) miles from such boundary streams used or to be used for the taking of fish in such boundary streauiB outside of the limit of one hundred feet from the mouths of streams tributary theroto; nor to own ers of such soines or nets resident with in ten miles of such boundary streams. Sec. 3. That section 2150 of Chap ter XI of Cobbey's Statutes of Nob. 1003, as heretofore existing be and is hereby repealed.
