was called to attend some preliminary
litigation glowing out of tho case of
the state of Missouri versus Nebraska,
which Is now pending In tho supreme
court of tho United States. Tho fickle
nature of tho Missouri river is the cause
of tho controversy between tho two
stales. MoKlsslck's island which the
inhabitants of Nemaha county claim us
their ewn was separated from the Neb
raska side of tho stream by a sudden
shifting of tho current. It Is alleged ,
that this was brought about by
unknown parties digging a trench and
otherwise Interfering with tho natural
courso of the ri vor. The inhabitants of
this small tract suddonly found them
selves subject to tho jurisdiction of
tho law? of Missouri when thoy most
earnestly desired to reside in Nebraska.
Tho attorney general claims that tho
tract of land atlll forms n portion of
Nemaha county. Ho nlso denies that
tho boundaries of this portion of the
state were definitely flxod at the time
of the admission of Nebraska. An er
ror in fixing the Missouri base lino
causes a wide difference in the surveys
of the two states, the baso line of tho
Nebrasku survey being the 40lh degree
north latitude while tho banc line of
tho Missouri survey Ib many degrees
further south. This togethor with tho
digging of the ditch and the shifting of
the channel is tho catiso of this change
According to this view tl.o Island is
still a portion of Nemaha county and
the residents subicct to the jurisdicrion
of tho Nebraska laws Lincoln News.
