fraudulent, voting tho law requires
that each mrtn- nnd woman living In
North Platte shall register before
voting. It Is a now law but It
Is .to he enforced. Ono man says hp
would Hko to soo them keep him from
voting, reglstor or not. Ho says he
has voted ovory eloctlon for twonty
years. This man doos not roallzo that
North Platto has grown to bo a city
of about 11,000 people and that elec
tion frauds aro posslblp which would
nof havo boon thought of twonty years
ago and that tho law Is a safeguard
to his voto as well as tho vbto of
every ono olso. If ho doos not register
and comes up to tho primary It will
bo his own fault If ho is refused the
prlvlledgo. Ho still has a chance to
register and unless ho takes that

the tests of citizenship and official service for thirty years; as a citizen

pose, and a sense of justice to suit every occasion and fit every circum

Janesvillc, Iowa, in 1861, and in
1887 camo to Kearney and engaged
In the practice of law. He wa3
elected mayor of Kearney for two
terms, and In 1904 he became judge
of the twelfth judicial district of
Nebraska comprising tho counties
of Buffalo, Custer, Logan and Sher
man. He has 'been district Judgo
for eighteen years, and has mado a
most enviable record.
Judge Hostetler is well qualified
for tho office ho seeks, and in the
event of his nomination and elec
tion will doubtless com as near
filling Mr. KInkald's shoes as any
man that could be picked from this

quarters to discredit tho candidacy
of Judgo Hostotler for congress by
assorting that ho la not a qualified
candidato for tho offlco, bocauso ho
Is holding tho offlco ot district Judgo.
To support tho assertion, referonco
is mado to Section 1139 of tho Re
vised Statutes of Nebraska, which
provides that no Judgo of tho district
com, of this state shall bo eligible as
a candidato for any other office, ex-
copt a Judicial offlco, during tho tlmo
ho Is occupying tho offlco.
Tho moaning and offoct of this
statuto was considered boforo Judge
Hostotlor becamo a candidate, and
has boon considered by parties in
torostod in other congressional dis
tricts. It will bo romombered that
Judgo Harry Dungan, of Hastings,
was n candidato for congress in the
Fifth Congressional district on the
democratic ticket . when this same
statuto was in force. Ho and his
frlonds then concluded that thla stat
uto was no bar to his candidacy for
congress, and It has been said by
good authority that this provision ot
our statute rotors only to other stato
offices and can not refer to fodoVal
offices.

States fixes tho qualifications ot
mombers of congress. Thoy must be
2G years of ago, seven years a oltl
zen of tho United States, and an in
habitant of tho state in which ho
shall bo chosen. ' All tho authorities
hold that it la not competent for any
state to add to or in any manner
chango tho qualifications for a fed
eral offlco as prescribed by the con
stitution or the laws of tho United

county court, in order to become a
candidato for congress, then tho Btat
uto would bo void as in contravention
of tho Constitution ot tho United
States under all tho decisions ot tho
courts.
Tho suggestion that Judgo Hos
tetler is not qualified to bo a can
didato for this offico arises out of
tho ambition of tho frlonds of his
opponents to defeat him for tho nom
ination. No one ought to bo mlslod
by this false alarm. Tho fact that
tho opponents of Judgo Hostnfi
obliged to resort to such tactics to
support ineir own candidato, ought to
stimulate his friends to still greater
activity, in his behalf.

of soveral days ago will say that I
haco no Intention of resigning from
tho bench myself. Frank Howoll, J.
P. Breon, Louis ToPool and several
other lawyers of first rank quality
havo told mo that in their opinion
district Judges who aro running for
federal offices aro not in any manner
controlled by tho sections of our
statuto, and I am inclined to that
view. Judgo Dungan, of Hastings,
whom you know very well, ran two
years ago without resigning, for tho
samo offlco that you and I aro seek
ing, and undoubtedly ho looked tho
matter up quito thoroughly boforo ho
concluded on that course. Tho World
Herald and tho entlro democratic
press supported Judgo Dungan without
calling on him to rosign, and as far
as I know no republican nawspapor or
anyono of any political relation eug
guosted that ho resign. I thought ot
all theso things before I decided unon
my our course.
