nnd Simmons ' remarked "I'll get oven
with you." As ho mrjlo the remark
.he pulled u gun and fired, tho ball
grazing Foster's arm. Fostor then
turned around tho corner and started
south on Pine, anjl as ho turned Sim
mons fired three shots one of which
took effect In Foster's back M14 tho
latter fell dead Simmons, after firing
tho shots, walked slowly south on Pine
with tho reported Intention of going
to tho Jail nnd jlollverlng hlmsolf to
the sheriff, but was Intercepted on tho
way by an officer an,; accompanied to
n cell.
Tho shooting grow out of a claim
for money which Simmons Insisted
Foster owed him, and which Fostor
apparently donlcd. According to
reports, when Simmons camo to town
Homo tlmo ago arid; was" without fund's,
Fostor gavo him somo extra work In
tho barber shop In order to holp him
along, and lator paid him a sum of
money which ho considered fair pay
for tho work porformtl. Tho amount,
howovor, was unsatisfactory to Sim
mons, and ho lintf placed a claim a
galnst Foster In tho hands of an at
torney for collection. Tho attorney
had sent Fostor a letter asking that
tho claim bo paid by Wednesday ov.
cnlng. This lottor was found on Fob
ter's person following tho shooting.
Shortly after tho Bhootlng Foster's
body wns convoyed to a morguo to bo
hold awaiting word from out-of-town
relatives or frloils.
