Secretary of Agriculture Houston has given down another opinion as to how ho and his department will stand on tho mattpr of usln? the federal good roads funds on parts of tho Lin coln Highway within the Union Paci fic right of way, his stand being as follows: First, ho will not approve any biases which purport to turn tho Union Paci fic ground over to the state or counties for use, and second, ho will not ap prove the expenditure of such funds if an out-and-out gift or bucIi part of tho railroad right of way is made to tho state or counties. In either caso the secretary says the title to tho right-of-way would bo ln seccuro, so far as tho stato or "its counties aro concerned. Tho road money, therefore it appears, from this cannot bo expended on the Lincoln highway, whore it hanDens to be locat ed on tho right-of-way.
