ceipts is an ovidenco that business is
booming. Tho tax is dependent on the
amount of earnings and it is clear,
therefore, that tho earnings must have
been large. Altogether, considering tlio
business depression and general condi
tions that prevailed whonnho came in
to office-. President Taft has reason to

Dear Sir: When reading tho Rev.
R. B. Fnvorlcht's communication re
garding the Unitarian (Hnll tltlo in your
last issue, i tnougni mat mo city at
torney, nnd citlzuns anxious to ncqulro
the site of that building for tho erection
of a city hall, had bettor go slow.
Having been necretary of tho North
Platto Unitarian Society for nigh twenty
yearn, I am conversantwith the history
of the hall, and it is' my opinion that n
clear tltlo to the proporty -unloos for
tho erection of a building exclusively
devoted to church mimosas -cannot be
obtained. Originally, two lots wero
deeded to tho Unitarian Socioty of
North Platto by tho Union Pacific Rail
road Company; but in ordor to mako
needed improvements on tho hall, tho
latoTVlra. E. J.'CoeswolI urired that tho
inHido lot bo sold to obtain money for
tho purpose. This vas done, and at tho
time several wcro of tho opinion that
tlio titlo was nbouL as flimsy as ono for
taxes.
During my tonuro of office n3 secre
tary, thorn whs a document, npart
from tho deed of tho property, that
stated that If it waa used for other
than rellgioun purposes, It would re
vert to the Railroad Company.
Tho property rightfully bolonga to
tho American Unitarian Association, as
it was legally deeded to it; for it con
tributed, liberally towards tho-liroction
of tho building, and in early days aided
the society In many ways. When tho
North Platte Unitarian Socioty dwin
dled down to a fow members, the few
combined, and disputed dip tltlo of
the American Unitarian Association to
to tho property. Tho case was carried
to tho door of the court, but rather
than go to law, tho American Unitar
ian Association agreed to. doed back
tho proporty to the fow representing
tho defunct socioty. Attorney's Hong
land &IIonglanrt woro retained by tho
American Unitarian Association, and
doubtless can throw light on tho
subject.
In conluHion, I would suggestthnt the
city attorney corhmuilictito with tho
Union Pacific hind office, and the Amer
ican Unitarian Association, whoso ad
dress is Ueueon street, Boston. I know
little about law, but nm nworo that
law Is sometimes ono thing, nnd justice
nnother; and after all, iu.mny be! pos
sible thnt a district judge has power to
give nonnimion to yell or encumber
proporty deeded to a society hi like
manner to that of tho North Platte
Unitarian Society. '

20th day of Juno, 1911, the Mayor and
City Council of tho city of North
Platte. Nebraska, passed and approved
an ordinance entitled:
"An ordinance granting to tho Ne
braska Telephone Company, its succes
sor and assigns, right of way for tho
maintenance of wires, undergronnd
conduits and appurtenances thoreto,
through, upon, over nnd under tho
streets and alleys of the streets of
North Platte. Nebraska; regulating the
erection and construction pf poles,
wires and conduits nnd protecting tho
same in said city of North Platte, etc."
And that on tho 13th day of July, 1911,
a petition was filed in tho office of the
,'clork of tho city of North Platto, signed
dv zii quatuieu voters 01 tno city ot
North Platte, the same being 20 per
cent of tho voters of such city, request
ing that the said ordinance "be re
ferred to the voters of the city of
North Platte, Nebraska, at a special
election in said city, to bo called and
held according to law, for their rejec
tion or approval".
Now, . therefore, J, Charles F.
Temple, city clerk of the city 6f North
Platte, by virtue of the powor in me
vested hereby cnll a special election to
bo held on the. 2nd day of August, A.
D. 1911, between the hours of 9 a. m.
nntj 7 p. m. in said city of North Platte,
for the purposo of voting on said ordi
nance., ,
Tho voting places nt said election
shall be in the First ward in said city,
at tho hose houso-in said ward, in tho
Second ward in Baid city, in tlio com
missioners room in the court house in
said ward, in the Third ward in Baid
city at the hose house in said ward and
in the Fourth ward in said city at tho
hose house in snid ward. ,
Tho Ballots to be-tiscd at said
election shall have written or printed
thereon:
Approving the ordinance passed and

quarter: thence southeasterly around
tno canyon in northwest quarter of
northeast quarter of said section nnd
back to section lino at about tho north
east comer of northwest quarter of tho
northeast quarter of said section thonco
east along said section line about thirty
rods; thence southerly across tho cor
ner of tho northeast quarter of tho
northeast quarter of said section 26 to
the intersection of the east line; thence
south along tho east lino of said section
to tee intersection of Road No. 212 has
reported in favor of the' location of
said roads as follows:
