7th day of September, 1920, the
Plaintiff above named, filed his
petition in the office of the Clerk
of the District Court of Box Butte
County, Nebraska, the object and
prayer of which is to cancel and re
lease from the records of said
county, a certain mortgage executed
by the above named plaintiff and
Mary C. Miller, his wife, on the 27th
day of July, 1914, to Green Wheeler
Shoe Company, which said mortgage
was filed for record in Box Butte
County, Nebraska on the 27th day
of July, 1914, and recorded in Book
28, of the mortgages on page 214,
Mortgage records of said county.
That the said mortgage has been
fully paid; and asking that the court
enter a decree, cancelling the same
of record in said Box Butte County,
and quieting the title to said
premises in the plaintiff, with such
other and further relief as the court
shall deem Just and equitable.

August, 1920, Lou Clyborne filed her
petition in the County Court of Box
Butte County, Nebraska, setting
forth that Wilson A. Clyborne, de
ceased departed this life intestate
on the 20th day of December, 1908,
at his residence in the City of Benton
Harbor, Berrien County, Michigan,
and being immediately preceding his
death a resident and inhabitant of
Benton Harber, Berrien County,
Michigan, and was possessed in fee
simple at the time of his death of
the following described -real estate,
to-wlt: The northwest quarter of
section eight. (8), In township
twenty-six (26), north of range
fifty (50), west of the sixth principle
Meridian in Box Butte County, Ne
braska; that the petitioner Is a
daughter of the deceased and the
owner of an undivided two-fifteenths
interest in fee simple in and to said ,
lands and derives her title to the J
same through the said Wilson A. I
Clyborne, deceased.
The object and prayer of said !
petition is that the court will ap-!
point a time and place for a hearing j
upon said petition and that notice ;
may be given and Issued to all per- I

the regular administration may be
dispensed with and that the estate of
the said Wilson A. Clyborne, de

period of more than two years has

being at the time of his death, a

than two years have elapsed since
his death; that the said Wilson A.
Clyborne, at the time of his death
was the owner of the northwest quar
ter of section eight (8), township
twenty-six (26), north or range
fifty (50), west of the sixth principle
Meridian in Box Butte County, Ne
braska, and that your petitioner Is
a daughter of the said deceased and
the owner of an undivided two
firteenths interest In r.ald lands; that
no application for administration
upon the estate of said Wilson A.
Clyborne has been made in the State
of Nebraska; that the sole and only
heirs at law of the said Wilson A.
Clyborne, at the time of his death
were his widow, Eliza Clyborne, and
their children, Edward Clyborne, a
son, of South Bend. Indiana: Fred
Clyborne, a son of Benton Harbor,
Michigan; Ethyl Clyborne Snell-
grove, a daughter of Elgin, Illinois;
Mae Quilliams, a daughter of Benton
Harbor,- .Michigan, each of whom is
over twenty-one years of age and are
the persons to whom said lands de
cended at the time of the death of
the said deceased.
It Is hereby ordered that a hear
ing be had on said petition In thoj
County Court room In the City of
Alliance, Box Butte County, State of
Nebraska, on the 25th day of Sep
tember, 1920, at the hour of ten
o'clock A. M. and that notice thereof
be given to all persons interested In
said estate both creditors and heirs,
of the time and place fixed for said
hearing by the publication of this
order ror three successive weeks
prior to said hearing in the Alliance
Herald, a newspaper printed, pub
lished, and circulated In said county.
