It is the order of the board that the
Sisters of Mercy of St. Bernard hospi
tal of Council Bluffs, Iowa, be notified
that the contract entered into by the
St. Bernard hospital and Box Butte
county, Aug. 24, 1906, is not satisfac
tory to the county of Box Butte county
to continue after this date, and that
payment will be discontinued from this
date; and the clerk is hereby ordered
to notify the Sisters of Mercy by regis
tered mail of this order.
Whereupon the board adjourned to
November 10th, 1909.

WILLARD OUT ON PAROLE
Judge Hostetler Suspends Sentence of
Custer County Man.
Broken How, Neb., Oct. 11. A num
ber of cases on this docket this term
were settled out of court and not n
few continued until noxt term. Will
iam E. Wlllard, who has been uudi
bonds for over two years, charged
with absconding with funds belong
ing to tho county treasurer while em
ployed as a clerk In that department,
pleaded guilty to the chargo and throw
himself on tho mercy of tho court.
Judge Hostetler susponded sentonco
under tho following conditions: That
Wlllard should pay back the monoy
ho had' taken, together with the ex
penses incurred by the' county In
bringing tym to justice, and that for
tho next seven years ho must report
at each term to this division of tho
district court. During that time,
should Wlllard violate tho law In any
way, ho Is to bo, brought Into court
and sentenced on tho original charge.
Tli.ls apparently disposes of a case
that from time to time has caused
some mild wonderment.
KEARNEY HELD FOR MURDER
Man Who Struck Supervisor Walthers
of Clay County Will Be Prosecuted.
Hastings, Neb., Oct. 12. Tho coro
ner's jury in tho caso of Supervisor
Poter Walthers of Clay county, whp
died in n sanitarium here, has re
turned a verdict finding that tho man
dlod of hemorrhage of tho brain and
setting forth that "wo are unable to
determine the cause of the Injury." Ten
days ago Walthers had an altercation
with John Kearney while attempting
to placo n quarantine sign on tho bat
ter's homo. Walthers was knocked
down. Tho physicians who performed
tho autopsy were unablo to say wheth
er or not the blows he received caused
the death, Kearney was taken Jnto
custody and County Attorney Caroy
of Clay county said he would fllo an
Information against him, charging him
with murder in tho second degree.
STATE AGAIN HAS A DEBT
First Warrant Registered Since Old
Debt Was Wiped Out In June.
Ljncoln, Nob., Oct, 9. For tho first
time sinco Juno 24 the state of Ne
braska has an outstanding debt. A
debt of $1,000, In tho form of regis
tered state warrants, appeared on
Treasurer Brian's books. There not
being enough monoy in the general
fund or the fund for tho redemption
of'outBtaudlng warrants, tho treasurer
had to buy tho warrants presented to
him by using trust funds, tho some
as was done for years prior to June
24, when there were no warrants reg
istered. Carey to Talk at Com Show.
Cheyenne, Wyo., Oct. 9. Judgo J.
II. Carey, former United States sen
ator from Wyoming, and' author of the
Carey act, which has been responsjble
for tho reclamation of almost 3,000,000
acres of arid land in this state, has
added his influence to the National
Corn exposition and will speak at
tho exposition In Omaha on tho recla
mation work and tho results obtained
by actual farmors.
Chamberlain Case Postponed,
Beatrice, Nob., Opt. 9. Tho caso of
the stato against C. M. Chamberlain
of Tocumsoh, charged with receiving

"Resolved, That Inasmuch as tho

appointed a Mormon elder as chap
lain of tho stato penitentiary, and as
this is resulting in tho complete de

Omaha, Oct. 8. George W. Bowers,

ago, was located at Fort Francis, Ont.,
by a representative of tho company.
Tho cause of his disappearance from
this city remains a mystery and offi
cials of tho company decline to dis
cuss the matter. They say, however,
that his accounts aro In perfect con
dition. Alleged Train Robbers Indicted.
Omaha, Oct. 9. Tho federal grand
Jury, which has been In Besslon hero
for two weeks, made a partial report,
returning Indictments against tho five
men held on charges of tho Union
Pacific mall robbery, May 22, 1909,
near Omaha. Thero are threo counts
la tho Indictment and' thoy are simply
to rectify certain technical errors In
tho former indictments.
Two Elevators Burn.
Lincoln, Neb., Oct. 8. Tno mam
line of tho Burlington railroad wost
from Lincoln waB blocked to all traf
fic frr ten hours by tho burning of
two grain elevators at tho village of
Denton, in this county. In addition
to the elevators, two business houses
and a resldonco were burned, with a
total loss of $40,000.

Omaha, Oct. 12. Tho first snow of
the season fell horo. It was light,
however, and melted as It fell. Frost
