Section 1. Amondxiont propoaoA. Thai
Section two (2) of Artlcio ill ( of tht
Constitution of tho State of Nebraska
amended to read aa follow:
Section 2. (Supremo eoartj Judfaa:
Jurisdiction.) Tho Supremo Court snail
consist of seven (T) Judge; and a ma
jority of all elected and qualified Judges
hall be necessary to constitute a
Suorum or pronounce a decision. The
Ureme Court shall have Jurisdiction lo
evil case relating; to the revenue, civil
cases In which the state la a party,
mandamus, quo warranto, habeas corpus,
and such appellate Jurisdiction aa may
be provided by law.
Section 2. ( Amendment proposed ) That
Section four (4) of Article nix ') of the
Constitution of the State of Nebraska bt
mended to read aa follows:
Section 4. (Supreme eonrt, JudfSB.
lection, term, residence.) Tho Judges ot
the Supreme Court shall be elected by
the electors of tho atata at large; and
their terma of office, except aa hereinafter
provided, shall be six yeara. And said
Supreme Court Judges shall during their
term of office reside at tho place where
the court Is holden.
Sections. (Amendment proposed.) That
Section five lb) ot Article six () of the
Constitution of the State of Nebraska be
mended to read as follows:
Section t. (Supreme eonrt. Judges,
leotlon, term; chief Justice.) That at
the general election to be held In the
tate of Nebraska In tho year 190, a '
each six years thereafter, there shall be
elected three (3) Judges of the Supreme
Court, who shall hold their office for the
period cf six years; that at the general
lection to be held In the state of Ne
braska In the year 1911, end each six
years thereafter, there shall be elected
three f!) Judges of the Supreme Court,
who shall hold their office for the period
of nix years; and at the general election
to be held In the state of Nebraska In
the year 1913. and each six years there
after, there shall bo elected a Chief Jus
tice of the Supreme Court, who shall
hold his office for the period of six
yearn. Provided that tho member of the
Supreme Court whose term of office ex-
5 Ires in January, 1914. shall be Chief
ustlce of the Supreme Court during that
time until the expiration of his term of
office. And, provided further, that upon
the adoption of theie amendment by the,
ientnr tit the State, the Governor shall.
Immediately upon Issuing his proclama
tion declaring said amendments adopted,

Court two (2) of whom shall be ap-1
pointed to hold said office Until their
successors shall be elected at the general

the other two (2) shall hold their office
until their successors shall be elected at
the general election held In 1911, and

Justice shall serve as such during all the
term for which he was elected. He shall

Court, and In his absence the Judges
present shall select one of their number
to preside temporarily,

Bioux City Journal, 28 : Jepson &
Jepson, of Bioux City, are interested
in the, actiou of the supreme court rf
Nebraska in sustaining the demurrer
that was filled to the issuance of an
original writ of mandamus in a Dakota
county ditch matter. The board of
u per visors denied a petition filed by
property owners who wanted the ditch
tiuilt to drain their farms. The latter
got out an origins! writ of mandamus
to compel the ordering of its constrm
tiou by the supervisors. The ruling of
the supreme eonrt in snstsiuing tho
d-mnrrer in effect blocks the building
of the improvement. The ditch was
the stili ct of much bitter contention.
It was to be known as the Jackson
I nke and Elk creek ditch and to cost
$80,800. I
