Shanghai, Dec. 29. Jndge Lobin-
gier of the United State! court for
China, has rendered a rerdict against
Swajrne & Hoyt, incorporated, an
American company, engaged in the
shipping trade, which has a vital
bearing on the attitude of Americans
toward the English black-list and is
attracting wide attention.
The American company, which is
represented in Shaghai by Jardine,
Matheson & Co., an English corpora
tion, refused to accept freight from
Leverett, a Shanghai forwarding
agent, because the freight was the
property of Germans or other per
sons who were on the British black
list. Consequently space was denied
on the defendants' steamship Yuca
tan, sailing from Shanghai for Japan
ana San Francisco last May. Japanese
steamship companies accepted the
freight, but at a higher rate, and the
rerdict of $2,700 granted to Leverett
against the American carrier was for
the difference in freight rates.
Everett was first denied space on
the Yucatan on the ground there was
no space. Other cargo was accepted
after this statement was made to him.
Evidence produced in the trial showed
that Jardine, Matheson & Lo., finally
told Everett the cargo could not be
accepted because the British consul
general would not give his approval.
In .his decision against the carrier
Judge Lobingier held that the mere
fact that the company was represent
ed in Shanghai by English agents
did not free it from responsibility
from the loss the defendant suffered
as a result of the discrimination made
against his cargo by foreign agents
who complied with tnghsn regula
tions in violation of American law.
As yet no appeal has been lodged
against the decision. Were the de
fendants to appeal, the hearing would
be in the circuit court of appeals of
the Ninth Judicial district, which sits
in aan hrancuco.
