of the Kansas legislature In 1907 to pro
tect coal miner by passing- a law reg
ulating the sale, delivery anil use of
black powder In coal mines today came
under the scrutiny of tho supreme couit
of tho Vnltod State.
Argument were heard on the consti
tutionality of thl law. Tho fight against
It ha been carried on In the name ot
J. If. William, who' wa convicted ot
selling powder. In violation ot the stat
ute, to John Thome, a miner, In Craw
ford county, Kan,
When William wag placed In 'Jail, after
conviction, he Bought to obtain hi re
lease on habeas corpus proceeding, con
tending that the law under which he was
imprisoned wa unconstitutional. Tho
Supreme Court of Kansas upheld tha law.

In the Hupreme court of tho I'nlteo
State an outline ot their argument fotr
today. They claimed that the law, in
limiting the esie of black powder to pack
ages of twelve and one-half pound, wa
an Interference with Interstate commerce.
In providing that the law should not be
come effective a to contract existing
at the time the law wa passed, for the
delivery of black powder. It waa con
tended that tho law made an arbitrary
classification of persons, with tha result
that th defendant waa denied the
"equal protection of th law."
Among other things', tha act provided
that It should be unlawful for any miner
to lake Into a coal mine black powder
except In original package ot twelve and
one-half puunds. and prohibited miner
from opening powder can In a mine with
a pick or other nietai Buoatance or in
strument, j Another provision ot the law
wg that no powder should be delivered
by hauling in any car propelled by an
electric motor, unless the car was thor
oughly Insulated.
