bert W. Merrill, a socialist, won out
where a democrat had held the seat.

shaken today In a battle of the ballots
In which local offices were mainly at
stake. The democrats successfully de
fended their ancient strongholds of Msn
hattan and the Hronx, but by greatly re
duced plutalltiea '
A year ago Manhattan and the Bronx
borouRhs gave (lovernor llx a plurality
of CK,3b9 and elected a democrat supreme
court justice by about 22.0U0. . Toduy
Itoberl I.. Fowler, the dumociatlo candi
date for surrogate, carried New York
county with a plurality of about 17,000.
In the First judicial district the demo
crats elected their candidate for sheriff
by about 8,000 and the three democratic
candidates for supremo court justice
pulled through by C.OUO. Francis M. Cook,
the fourth justice elected, was indorsed
by both parties. The republicans gained
assemblymen in New York county and
will send fifteen members of that body
out of the total delegation of thirty-five.
The republican candidates for supreme
court justices In the Second judicial dis
trict, which comprises Kings, wueens and
I ltlchrnond counties were elected with one
possliilo exception. William Wlllett, Jr.,
the democratic candidate w..o was
charged with buying his nomltiutlon, ran
about 8,(M behind Callahan, who Is so
close to the last man on the republican
list that his fate remained In doubt
until the last district was heard from.
The republicans elected a sheriff In
Kings county by about 14,000. in nine
teen out of twenty-three districts In
lirooklyn the fusloulsta gained six as-semblmen.
however, he admitted, lay his hand upon
Judge Uodd'a shoulder, but In a manner
so gentle as t J be almost caressing.
Judge Moss described the Instance three
years ago when In a tax suit Judge Dodd
had Intimated that a statement of his

malice against him and have not now.

Judge Moss Is more than six feet and
weighs 170 pounds. Judge Dodd Is small

KANSAS CITY, Nov. 8.-Former County
Judge C. K. Moss testified In a case In
which he Is sued for 15,0U) for an alleged
tweaking of the judicial nose of Ueorge
J. Dodd, also former county judge, be
fore a jury in the circuit court here to
day. Judge Moss admitted having called
Judge lodd an "Insignificant little
shrimp," but denied having finger nails
as "long as a Chlnamun's" as was ac
cussed, or thst he had "clutched" Judge
Dodd by the throat or nose. He did,

Eehearsing Play
He Had Written
ELMOHW, Minn., Nov. S.Harry Blair,
was shot and almost Instantly killed last
night near hero while rohearslng a play
which he had written. The actors, all
amateurs, were going through Indian
parts when the accident occurred.
Clarence IlesNledahl had been given a
revolver by Hlulr and when the time
came In the play for Hessledahl to shoot
Blair, he fired, thinking the gun was
mpty. Blair twice walked across tho
room In which the rehearsal was taking
place and dropped dead.

unloaded the weapon before giving it tj
