Session at Columbus
Visitors Are Delightfully Entertained,
Being Lunched and Taken to
Ball Games.

Visiting Nebraska Eagles are hers to at
tend the sixth annual state meeting of the
order being held this week. Among the
first delegates to enroll were thoes from
Florence and North Platts and later repre
sentatives from Omaha, South Omaha,
Plattsmouth, Benson, Lincoln and Grand
Island added to the attendance.
Tuesday was opening day and the dele
gates, after enrolling, attended the public
reception and opening meeting at the
Maennerchor hall. The delegates were
welcomed In an address by Mayor Louis
Held, which was responded to by State
President Tracy of Benson. H. B. Fie
ri arty of Omaha delivered an address, after
which the stats president named the com
mittees. At ths adjournment of the session the
delegates sod visitors paraded to ths ban
ground, where they witnessed the game
between Columbus and York of the Ne
braska State league. In the evening the
visitors met at Eagles hall and were taken
to ths North opera house 'or a theater
party, the evening concluding with a Dutch
lunch at ths Eagles' hall.
Today was devoted to business sessions.
At S:S0 ths visitors witnessed the ball game
between Columbus and Beward, At S p. m.
ths ritual was exemplified at Eagles' hall
and two prizes given for the degree teams.
Thursday the session will be concluded
with the election of officers and a banquet
at the Maennerchor hall.
Grand Island wants the next con Tension.
So far there has been no slates for state
officers, with ths exception of two South
Omsha men. Jay Williams and J. M. Tan-
ner, who ara mentioned for the stats presi

cial.) At a rood roads meeting: it was
proposed ths road .begin at the east end
on Fourth street 1n this city and extend
east until the North Platte . river Is
reached. ' There the river Is to bo crossed
and the bank followed a short distance to
tho section line. It will then follow this
section. line until the right-of-way of the
Union Pacific Is reached and then parallel
the Union Pacific to Maxwell. This high
way would ba somewhat shorter than ths
Union Faolflo railroad between these two
points. An executive committee consisting
of R. H. Fowles. William Hendy of this
city and W. M. Plummer of Maxwell was
appointed. It is proposed to build a per
manent steel and concrete bridge across
tb river.
Contractor Baste is removing the walls
on Dewey and Front streets from the store
buildings owned by M. Keith Neville, and
these will be replaced with pressed brick
fronts and plat glass.

Portions of the work of the subcontractors,
such as the painting and installation of
lighting fixtures and furniture, are not
yet completed. The building is constructed
of reinforced concrete, with marble and
brick walls for exterior and has Interior
walls largely of marble and floors of ter
asio. '

sical valuation department ef th Stat
Railway commission has oompleted Its valu
ation of ths Chicago, Minneapolis, St. Paul
It Omaha property In ths state, ths figures
of th stats official and th company vary
ing but UtU a to property values. On
ths valuation for taxation purposes, how
ever, there is a considerable divergence, the
company's figures, being nearly 12,600,000
lower than that of the Btate Board of As
sessment. Ths ratlwsy commission's valuation for
July, 1909, was ti0,686,S22.n reproduction
ralu and S8.7ZS.996.81 depreciated value.
Th mileage ot th road as found by tb
railway commission Is 1372.66, which makes
a valuation of $28,414.90 per mile, reproduc
tion value and S2S.42g.S6 depreciated value.
The only figures received from the rail
way company's valuation department is a
Uon value, and 13.428.38 depreciated value.
Last year the State Board of Assessment
taxed the eompany on a total valuation of
$12,633,763 , and found the mileage to be
304.79 miles, which made a valuation of
$41 450 a mile. The assessment board's valu
ation for two or three years preceding 1910
was about the same.
The railway commission will hold a hear
ing In a short time . for the . purpose of
giving the Minneapolis dt Omaha an oppor
tunity to object to the valuation proposed
by the commission.
Anderson Divorce Decree Affirmed.
The court affirmed ths divorce given
Hulda Anderson from Axel Anderson, In
Douglas county. Anderson pleaded that th
$2S a month alimony was excessive, that
his wife had condoned his previous cruelty
and that the trouble he had caused her was
due to his mental Irresponsibility. They
separated once and Anderson was brought
to a private sanitarium In Lincoln. From
there he wrote such a pitiful letter that his
wife forgave him and came to him. After
he came back he fell Into his old ways. The
court says that oondonation Is forgiveness
for the past upon condition that the wrongs
shan not be repeated. It la dependent upon
future good conduct and the repltltton of
the offense revives the wrong condoned. A.
promise of foiigveness is not- alons suf
ficient to constitute condonation. To have
that effect such promise must be followed
by a restoration of the offending party
to all martial rights. .Insanity, to be avail
able as a defense, must be pleaded.
' Decision Aaralnef Dodge Coaty.
The supreme court today put a final
crimp In the aspirations of Dod gecounty
to levy an Inheritance tax on mortgages
owned by eastern men of wealth. The spe
cial case was one where it was sought to
collect from the estate of Ira Davenport.

debt owed by a resident of Nebraska to a
nonresident, a duplicate of the contract
evidencing such a an existence of this as

Floyd Flinn may proceed to collect
$1,019.40 from H. E. Frederlckson, an auto
mobile dealer of Omaha, for assault and
battery and for conversion of a machine,
Fllnn had purchased a motor car from
Frederlckson and the latter, fearful that
Fllnn did not Intend to pay out on It, con
trived to get him to bring the machine to
his garage. Then Frederlckson made Fllnn
make an overdue payment and when Fllnn,
after doing this essayed to take the car
away, Frederlckson Jumped on him, bat
tered him and called him a thief before a
Jeering crowd. The court says a Judgment
for $660 for this Is not excessive. The re
mainder of the Judgment Is for ths Interest
of Fllnn In the machine which Frederick
son kept.
