Lane said Tuesday morning- In reference
to the further trial of the land fencing
caaes at thin term of the federal court:
"It In probable there may be no further
trials of these canes during the May term.
The reasons for tills are that mot of the
Indictments were brought prior to the en
actment of the Klnkald law, and as vast
tracts of land hitherto under Illegal fence
liave been formally entered under that law,
the Indictments would have to be readjusted
to meet the new conditions. We could
hardly afford to go to trial without ome
assurance, of a conviction. The Indicted
parties might say, it was true they did
have lands under fence that were a part
of the public domain, but since then they
had acquired the land under the Klnkald
law, and It is extremely doubtful whether
a Jury could convict under those circum
stances. Consequently, on this very
ground was a continuance secured In the
' Bartlctt-Rlchards cases.

"New surveys will have to be made In
order that the Department of Justice can
make absolutely suro of its premises. The
three speclul agenta of the land depart
ment, DeKreea, Nixon and Chambers, are
now In the field looking after these sur
veys and securing new evidence. It will
be largely from this new evidence that the
grand Jury of November will be called
upon to act. Yet we propose to go right
along with the work and will bring civil
action against the parties illegally enclos
ing public lands, and If the fences are not
taken down within the time prescribed
criminal action will be brought. The civil
processes will be in the nature of injunc
tion proceedings and we will not have to
await the action of the grand Jury In such
cases. The instructions from the Depart
ment of Justice are to proceed with the
work and require the removal of the fences
at the earliest practicable moment, either
by legal proceedings or by force If necessary."

reduced to eighteen hours, leaving Chicago
20 p. m., arriving Grand Central station.
New York, 9:30 next morning.
Returning, leave New York 3:30 p. m.,
reaching Chicago 8:30 the following morn
ing. The new schedule will be made with
the same ease and comfort that have char
acterized tbc running of this favorite train
under the present schedule of twenty hours.
