, A suit is now on trial in Judge Bears'
court which "hows anew that human na
ture Is ever trusting, even when money Is
involved. It Is a suit against the stock
holders of the old Omaha Gas Engine com
pany by judgment creditors holding claims
amounting to between 6,0OO and $7,000.
Among the prominent people In the list of
of stockholders defending are Dr. Walter
O. Henry, Dr. K. XV. Cook of Plattsmouth,
Charles A. Trary, cigar dealer; Frank A.
Brownlee, secretary of the Board of Fire
and Police Commissioners; Oustave Ander
son, United States commissioner; Squires
4c Smith and John I... McCngue, the latter
holding; one or .(wo chares, understood to
have been taken for rent.
In 1899 there was organized In Omaha the
company named above, with a capital stork
of $100,000. The organizers were H. K.
Clover, who claims to have a patent im
proved gas engine; Otto Gugler, H. C.
Akin, Dalton Ridley and Dr. Frank B.
Coulter.
Tha company gave all of the capital stork
to Clover for his patents. Then, in order
to gat money for operating expenses, the
stock wss Increased to $150,000, and the ex
tra amount was put. In tho treasury for sale,
with Bamuel McKee ns authorized agent.
This Is where a few more Omaha men got
Into the good thing. About this time Wil
liam O.' Pratt, W. C. Gcnn and McKee
Conceived the Idea that they ought to get
control of the company and be the whole
thing themselves. At least, this is the
allegation of the litigants now In court.
Akin Thrown Over Transom.
McKee, having the handling of the stock
that was for sale, with his friends called a
meeting for the night preceding the annual
meeting of the company. It was averred
that at ,thls meeting enough stock was is
sued to friends of the man named to give
him eontrol, and that on the following
night they ousted the old officers, throwing
President Akin bodily out of the meeting.
They also had to depose Dr. Coulter, among
others. This was on January 2, 1900, and It
Is alleged this Is tho date when 100 shares
of stock were Issued to Ounnar A,. I-.lndo.uest,
forty-five shares to Squires & Smith, and
various blocks of shares to others. A
new board was elected, and Pratt, McKee
and Genn were In the saddle.
Interested parties did not like the looks of
things as they were framed up at this point
and undertook to get a look In. Attorney
Lysis I. Abbott, acting for the Paxton &
Vlerllng Iron company, sued out an at
tachment for $500 on the plant, located at
Twenty-eighth and Sahler streets, and this
brought the affair quickly to a head. Ab
bott's suit was filed May 10, 1900,. and on
the 24th of the same month Dr. Coulter
asked for the appointment of a receiver.
Judge Dickinson granted the application
and named as receiver his bailiff, Edward S.
Stout.
When the receiver went to take posses
sion he found, as alleged, that much of the
valuable machinery and tools had been spir
ited away or disappeared. It is further
alleged that the custodian was taken out
at night for several nights, and treated,
while the looting of the plant was going
on. Writs of replevin failed to turn up
much of value, and Attorney Abbott's cli
ents only got about $28 worth of stuff. At
the show-down the assets of the company
amounted to a little over $400, while the
Judgments have piled up to the extent of
nearly $7,000. As the plant put In was un
derstood to have cost several thousand dol
lars, the creditors were very angry, as well
aa surprised.
Claim of Defendants.
Suit was brought against the 'Stockhold
ers, and it Is this action Judge Sears Is now
engaged In hearing. Defendants, of whom
there are half a dozon besides those named,
set up that they never subscribed for any
stock; that If they did subscribe they paid
for the same, and, lastly, that as some of
the Judgment creditors are also stock
holders, they should be compelled to stand
their share of any amount that may be
found due.
On the stand Wednesday morning Com
. tnlssloner Anderson admitted that he had
put $6,000 Into the concern. Dr. Coulter
feels that It was because of his name on
the list of officers that several other men
bought stock, and, taken all around, the
case Is quite notable. The lawyers representing-the
discordant Interests comprise
half dosen or more of the best at the
local bar.
MARRIAGE BOND IS DENIED
Defense of Man- Who Is Arrested on
Charge of Abandoning

Some ; weeks ago Isaac .Sllkett was ar
rested for wife-abandonment., When ar
raigned In the police court he pleaded as
a bur to prosecution that the woman was
not his wife. He suld he had never been
divorced from a former helpmeet. Dis
charge followed soon.
Neat BUkett was arrested on a charge of
child-abandonment and (or some time has
been confined In the county Jail. On Mon
day he was arraigned before Judge Day
ami pleaded not guilty. Wednesday morn
ing Mrs. Sllkett, aa she supposed herself
to be until the police court episode, ap
peared before Judge Day and gave bond
for the man who had denied her. She
did this, aa she said, so that he might be
able to. go to work and contribute to the
support of herself and child, and Sllkett
promised to do this.

Rite Masonic bodies of the United 6tates
will arrive. In the city this afternoon
about 8 o'clock from Sioux City for a brief
visit of inspection of the order in this city.
He will be given an automobile ride about
the city during the early part of the after
noon and In the evening an Informal re
ception will be tendered him by the Scot
tish Rite body at M&sonic temple.

Vaudeville Pala Fight.
Bruce Rehlrdon and George Brooks of
the vaudeville team of Brooks and Carr
engaged In a quarrel at Thirteenth and
Cuptiol averue Wednesday afternoon at
2 ;t o'clock, and as a result Umoks was
severely cut about tha face. George brooks
claims that Rehirdon approached him on
the street and wanted tu sell a package
of needles, which the former refused to
buy, and. being angered, whipped out a
riior and proceed-d to cut prumiselously
