Phil Warehnm, who made an unsuccess
ful attempt to take his own life by cut
ting his throat, has sufficiently recovered

the Konrd of Education and the Board of
Health over the compulsory vaccination
rrder, rested on their arms yesterday.
The only move made was by the Board
of Education engaging Attorney 3. J. Stew
art to conduct the proceedings In court
dPtermlned upon at the meeting of the
board Monday nlsht.
Not desiring to tnke undue advantage
of the Hoard of Education the Board of
Health yesterday decided to Five It ample
time to prepare Its proposed Injunction
suit. City Marshal Richmond wnlteT on
President Mess ot the Board of Education,
and learning from him that the board had
placed the matter In the hands of an
attorney, decided to keep his hands off,
and let the question be determined by the
court. City Solicitor Snyder also iug
gCRted that the Board of Health take no
further steps for the present, until the
question had been submitted to the court.
Attorney Stewart and City Solicitor Sny
der will get together this morning and
determine aa to the manner In which
the question ahall be submitted to - the
court. As both sides are anxious for a
ruling by the court. It Is expected that
the case will be submitted on an agreed
statement of facts and the two attorneys
will this afternoon decide as to what facts
they can agree upon.
Every effort will be made to have a
speedy hearing, and as Judge Thornell
Is busy with the Doyle-Burns trial. Judge
Wheeler will be asked to hear It.
Mr. Stewart, When asked last evening,
said that he had not determined In what
manner to bring the matter before the
court, but thought It would probably be
In the shape of Injunction proceedings to
restruln the Board of Health from de
barring children from the schools who have
not compiled with the vaccination edict.
Tha Injunction will be asked for probably
on the ground thnt the Board of Health
In Issuing the vaccination order exceeded
the authority vested In It for the alleged I
reason that existing conditions do not con
stitute what could be termed an epidemic
of smallpox, nor a threatened epidemic'
In order that Its order might not work
a hardship on those too poor to pay for
vaccination the Board of Health has ar
ranged with City Physician Tlnley to
vaccinate all those who may apply to him
and who are too poor to pay a physician
for such services. Dr. Tlnley has an
nounced that he will be In the mayor's
office In the city building every afternoon
from 4 to 6 o'clock for the next ten days
to perform free vaccination.
The Council Bluffs Medical society last
night parsed resolutions Indorsing the
action of the Board of Health in seeking
to force the vaccination of teachers and
school children and other rules of the
State Board of Health.

Except for the frequent Interruptions
caused by the clashes between opposing
rounael the proceeding yesterday In the
Doyle-Burns ease were more or less mo
notonous. Doyle was all day on the wit
ness stand under cross-examination of the
most rigid Character by Mr. Thomas, who
attacked Mm from all sides.
Affidavits, power of attorney, and num
erous other documents were offered by
the counsel for th defense In refutation
of the witness' assertion that he had but
little or nothing to do with the business of
the Portland company, and that Bums
had attended to all of his business af
fairs. Although the defense announced that Ita
cross-examination of th plaintiff would
probably be completed by noon todsy. It
will not release Mr. Doyle from th wit
ness stand. II will be subjected .to re
examination by hi own counsel, and then
when this la finished th defense will start
in again on re-cross-examlnlng htm. It
now looks aa .though Mr. Doyle may be
on the stand for the balance of the week.

Is now admitted by both sides.

the lobby yesterday, there were a number
of women . who listened to Mr. Doyle's
cross-examination with unconcealed Interest.
Meeting of Whist Leaarne.
Arrangements are under way to hold a
meeting of the Southwestern Whist league
of Iowa In this city some time during
April. The date has not yet been decided
upon, but It will be somewhere about the
middle of the month. The meeting Is at
the Invitation of the Council Bluffs Whist
club, which Is a member of the recently or
ganised league.
The Southwestern Whist League of Iowa
was organised a few months ago at At
lantic and at the outset comprised the
towns of Harlan, Shelby, Atlantic, Red
Oak and ' Council Bluffs. At th meeting
here It Is expected that a number of towns
In this section of the state will bo repre
sented and will Join tho league. Advices
received by the local club Indicate that
there will possibly be an attendance of
nearly 100 players. The tournament, ac
cording to present plana, will last two
days and the sessions will probably be held
In the large ballroom of the Grand hotel.

Visitors Taken for Burglars. '
'Abouth 9:30 o'clock last night a telephone
message was received at police headquar
ters to the effect that burglars were ran
sacking the residence of O. H. Brown,
the Main street druggist, at 232 Tenth
avenue, and requesting . that a couple of
officers be sent there on the run. It was
Mr. Brown' himself who sent the message,
some one of the neighbors having tele
phoned htm at the store that burglars were
In his house. As it happened, Mrs. Brown
was out spending the evening with friends
and after supper Mr. Brown had securely
locked up the house before returning to the
store. .
When Captain O'Nell and Patrol Driver
Plntner reached the house they were met
by Mr. Brown, who was waiting their ar
arrival Officer Platner on trying the front door
discovered it waa unlocked. Revolver In
hand he entered and cautiously made his
way to the dining room, where he found
George S. Davis, the well known Broad
way druggist and a party of friends pa
tiently awaiting the arrival home of Mr.
and Mrs. Brown.
It happened to be the anniversary, of
Mrs. Brown's birthday and a number of
her friends had gathered to give her a
surprise party. Finding no one In the
house the party had taken possession, one
of the number having a key which hap
pened to fit the lock of the front door.

with obtaining money from Loan Broker A.
A. Clark by mortgaging household furni
ture alleged to be the property of his
mother, was discharged yesterday by order
of Judge Scott. The young man's mother
yesterday morning declared that the furni
ture waa the property of her son and this
accordingly disposed of the rase, as Clark
Is protected, the statement of Mrs. Walker
establishing the lien . of the mortgngo
against the furniture. Walker's hearing
had been continued until today, but after
the mother declared the furniture belonged
to the young man and not to her Judge
Scott ordered hi release.
Weber Not Dangerously Hart.
A. L. Weber, the mall clerk who wa In
jured In the wreck on the Rock Island,
near . Homestead, la.,' on Monday arrived
home last night. Press dispatchea at
first announced that Mr. Weber was fatally
Injured, but thl fortunately proved not
to to the cae. Mr. Weber was severely
bruised and shaken and his head was cut.
While hla Injuries are severe and painful
and will keep him In bed for some time,
they are not considered serious. Mr. Weber
resides with his wife and: little daughter
at 407 East Washington avenue.

Sixtieth Wedding; Anniversary.

(Special.) Yesterday Jacob S. Fountain
and wife celebrated their sixtieth wedding
anniversary, at which occasion twenty-one
grandchildren and fourteon greatgrandchil
dren were present. Jacob 8. Fountain and
Athalenda B. Cook were married at Cin
cinnati, O., on March 20, 1845. They came
to Council Bluffs . In 1857, but soon re
moved to Harrison county, where Fountain
named Cincinnati township after his old
home. Mr. and Mrs. Fountain were the
parents of eight children.

$1,600 diamond robbery of Saturday night,
la causing the police of this city consider
able uneaslpess. Ijite last night an un
identified man entered the drug store of
W. A. Graham, at Sixth avenue and Stat
street, which Is a mile or more from th
business center of the city. Carl Sheark,
the clerk was alone and he was forced,
to the cellar w litre he was locked up.
The burglar then proceeded to take all
the cash In the store. Including the money
belonging to the postoltlce. the store being
a substation, and amounting to about
1150. Sheark thinks he could rfcognlt
the man should he see him again. Tha
police and postofflce Inspectors are work
ing on the case.

tic physician, la likely to be named by
Governor Cummins as a member of tha
State Board of Health to All the vacancy
caused by the expiration of the term of
Dr. McKlveen. It develops that a number
of the eclectic doctor down In the south
west comer of the state would Just as
soon have a regular appointed this year
so that the nppo'Mnient of an -eclectic
might go to that section next year. But
the eclectics are entitled to the appoint
ment this year and would not be next.
Teat Juvenile Conrt Lav.
Tracy home, which was formerly the de
tention hospital for tho city, has been
turned over to the Iowa Humnno society
by the city counrll for use for the Juvenll
court for the next two years. This Is that
the law may be given an adequate test.
The city has been paying a watchman to
live In the building. Under the will of tha
late James Callanan a provision Is mad
for the support of the widows and families
of drunkards. The home will probably b
used for this purpose also to some extent.

Lincoln' Election Sore.
Friends of Colonel James Rush Lincoln
of the Fifty-fifth regiment claim that his
re-election Friday Is sure because of tha
fact that a petition signed by all the com
panies of the regiment but one pledges his
re-election. On the other hand, his oppo
nents state that since that time Major John
C. Hume haa been superseded In the ad
jutant's office and Lincoln Is he($V with
Colonel Dows, as being responsible for It.
