By virtu of thrlr friends, the railroads, Omaha oonsumers of coal yesterday were given the privilege of paying on an average of 1$ centa more a ton for soft coal. That In what the new freight rates put Into effect today by the railroad dlscrlml ratlnx against Omaha to the advantag of the Kanaaa City, Rt. Joseph and other flown-rlver towns, amounts to to the "plain people." The advance In price to consumers was placed by local dealers at 15 cents per ton, although In tome cases the advance In freight rates Is more than this and In oth ers slightly less. It was deemed beet by dealers to make a flat advance of 15 cents per ton to avoid confusion. The new prices on the various grades as announced are: Cherokee steam, 13.15 per ton; Cherokee mine run and nut, Iowa and Missouri mine run and nut, 3.9u; Iowa and Missouri nut mixture, $2.10; Iowa and Missouri slack, $2.56. The above prices are In -wagonload lots. The prices In carlota tiavs undergone a similar advance. All the lines save the Northwestern are In receipt of the new tariffs advancing the Tate. Th Burlington tariff quotes blanket rate on Irihip, egg and nut of $1.30 from main line points and a blanket rate of $1.15 on screenings pea and slack from the same points tn Iowa. From points on branch lines rf th Burllnrton In Missouri and Iowa blanket rates likewise have been made to apply from each branch. Old Tariff Rates. Th old tariff In effect before today quoted various rates from main line points rang ing from S9 cents on slack up to $1.01. Some Of th rates on lump coal have been slightly reduced In order to make the same rates apply from all points on the main line. In speaking of the new tariff a railroad official said: " "It seems probable to me the rates Just mad affective will not be allowed to stand long, unless like advances are made to southern Missouri river . points. I under stand that such advances will be made ef fective, but Just how soon I am unable to say. I think there has been a great deal of unnecessary agitation regarding this rate matter for th reason that the advance is simply a readjustment of the rates to se cure uniformity as a comparison of the tariffs will show. The readjustment neces sarily has had the effect of raising the rates from many points, but It likewise has had th effect of reducing the rates from other points, although taking all Into con sideration the advance bos been greater than th reduction." As coal men figure it the advance amounts on an average to about 15 centa per ton, as is shown by their action in raising th price this amount to the consumer. The United States circuit court of ap peals has handed down a mandate sus taining the action of the United States circuit oourt for the district of Nebraska whereby the memoranda opinion of Judge McPherson is sustained and the motion for a new trial overruled tn the case of Free man Clancy, a minor, who brought suit against George E. Barker and others for damages In th sum of 150,000. 1 Suit was brought in the United States circuit court in February, 1803, by Freeman Clancy, by his next best friend, Catherine Clancy, bis mother, against the Barkei hotel for $60,000 damages sustained by the child, through the Iobb of a finger and an eye, caused by the discharge of a pistol In the hands of the porter of the hotel while the plaintiff and his parents, actors, wer guests at the hotel in January, 1902. Th child, but t years old, had been run ning about the corridors of the hotel, much to the annoyance of some of the guests. It Is alleged, and to the particular annoyance of the porter. The porter Is said to have playfully pointed a loaded pistol at the child and it was accidentally discharged, the bullet striking the child and causing the loss of a finger and one eye. 1A the trial of the caso In February, 1903, a verdict was given for th defense and the plaintiff appealed to the United States circuit court of appeals, asking for a new trial.
