terday Judge Munger directed the Jury
In the case of James B. I'latt of New
Tork against Hitchcock county, Nebraska,
to return a verdict for Hitchcock county..
Eult was brought to recover on the sale
of 818,000 Irrigation ditch bonds Issued by
Culbertaon precinct, Hitchcock county, for
the conatructlon of an Irrigation and power
ditch. The bonda were voted June 17,
1890, and the ditch was built and the bonds
lasued and aold, riatt being the purchaser.
' It was then discovered that the bonds had
been Illegally Issued and Hitchcock county
resisted payment. The grounds of Illegal
ity were that Culbertaon precinct could not
Issue bonds for any purpose In excess of
10 per cent assessed valuation of the pre
cinct. At the time of the vote on the
proposition to Issue the bonds there was
also an outstanding precinct bonded Indebt
edness of (3,000 'on the assessed valuation
of the taxable property of the precinct for
the year 1890, being the last assessment
prior to he vote upon the issuance of
the Irrigation ditch bonds, which assessed
valuation waa 169,110.53.
Denies Power of Precinct.
In view of this fact the defendants held
that the precinct had no power to vote
upon the Irrigation bonds proposition for
the sum of $18,000. Notwithstanding, the
Irrigation bonds were voted for June 17,
1890, and the county commissioners di
rected they be issued. But now It Is de
nied that the conditions precedent to the
execution, issuance and delivery of the
bonds were met, kept and performed by
the county and precinct. Denial also Is
made that a transcript or history of the
bonds, setting forth the proceedings by
which they were issued, Vhowtng the as
sessed valuation of Culbertaon precinct was
$216,673, was ever duly presented to the
secretary and auditor of state, or that
they were certified to these officers, or that
they were ever registered according to law.
The case was tried early during the
present term before a Jury, but Judge
Munger withheld his instructions to the
- Jury until a later period. The Jury was
reassembled and Judge Munger directed
it to bring in a verdict for the defandants
on the grounds herein related.
The attorneys In the case were Fred Shep
herd of Lincoln, for the plaintiff, and E.
B, Duffy and F. H. Oalnes of Omaha and
P. L Fobs of Crete, for Hitchcock county.

Senator Allen Challenges the Assault
of Rev. Yost on the Dead
Senator's Name.
MADISON, Neb., June 16. To the Editor
of The Bee: My attention has been called
to the baccalaureate sermon of Rev. Robert
Tost, appearing in your issue of June 13, In
which he says, among other things:
I would rather live the rest of my days
In the slums of this city or another city,
credited by God s grace, than be heir to
the black, corrupt, suspicious career of a
man who declared tnat every energy
should be bent lor himself Quay. The time
will come when the majority will want to
scratch his name off and remembering
Moody will lite him up and say, "X would
be a man like that."
I am certain that those who enjoyed the
acquaintance of Senator Quay and knew
his many admirable traits, will deeply re
gret that Mr. Yost uttered these strictures
on the life of one who by reason of bis
death is unable to defend his own memory.
After eight years of association with
Senator Quay, whose political beliefs were
radically different from mine, and with
whom I bad no political sympathy, I take
pleasure In saying that In my Judgment
he was an honest man; that his methods
were open and honorable, and I know that
he endeared himself to those with whom
he came in personal contact. More than
once It became necessary for .me to rely
on his word and he never deceived or mis
led me. He kept his word religiously.
Senator Quay never explained any charge
made against him; he denied no accusation,
but lived in the consciousness of the purity
of his motives and the rectitude of his
.purposes. If Mr. Yost knew that John
Wanamaker waa the man of all men who
made bitter war on Senator Quay, to the
end that be might 'Succeed blm In the
United States senate, and that he did not
top short of having his paper, the Phila
delphia North American, print libelous ar
ticles againat Quay in almost every Issue, '
and if he also knew that Waiuunaker's mo
tives were questionable and his methods
frequently disreputable, he would not be
guilty of stating that Senator Quay was
"corrupt" and "the time will ' come when
the majority will want to scratch his name
oft."
The relation between Senator Quay and
myself - was not Intimate, but sufficiently
close to enable ma to change my mind re
specting him after I met and became ac
quainted with him and to learn to fully
appreciate his many excellent qualities of
head and heart. No man of the present
generation has done more for Pennsylvania
than' Mathew Stanley Quay. He was an
able man and valuable as a senator, and
did much for the advancement of the people
at large.
While he was not a great orator and did
not shine brilliantly in the forum of die
ousslon, he was a good, strong, clear-headed
debator, a man of marked individuality and
of strong convictions and honest purposes.
It seems to me It would be better for Mr.
Yost to pplse his lance at the Uvlng rather
than to drive it Into the tomb of the dead.
I am prompted to write as I do not be
cause I am under obligations, personal or
Political, to defend the memory of the dead
statesman, but because I believe I am In
a position to know that the criticism is un
just and should not go uncontradicted. I

going after the unsatlaf actory baggage
rates now in effect Post A will have a
big meeting Saturday evening at the Her
Grand hotel to discuss the limits and reg
ulations .and charges now in effect on the
lines running through Omaha territory.
The traveling men feel they might receive
more liberal treatment in the matter of
their baggage. In addition to the business
in hand, Post A will hear a report from the
delegates who represented the horn winners
at the national convention. One source of
satisfaction to these was the vindication
and reinstatement of Louis T. Lebeaumo,
the secretary-treasurer of the national
body. An attempt waa made at the con
vention to have him impeached on the
ground that his accounts were incorrect
He was reinstated by the executive council
by a vote of 197 to S3.
